    OPCON/XPS Entity Wide License
    
    1.	Advance Contract Award Notice (ACAN)
    
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods or services to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 
    
    2.	Background
    
    Shared Services Canada, on behalf of its Client, the Department of Employment and Social Development Canada (ESDC), intends to enter into a contract with Software & Management Associates, for the purpose of acquiring  Entity Wide subscription and support Services for Opcon/XPS.
    
    2.1.	Deliverables
    
    1.  	One (1) year subscription for OpCon/XPS - Entity Wide authorized usage;
    2.  		Annual Support for OpCon/XPS for an initial nine (8) month period from the date of contract award until March 31, 2016; 
    3.	The contract will include four (4), one (1) year option periods to extend the subscription and support up to March 31, 2020.  	
    
    2.2	Estimated Contract Value
    
    The total estimated contract value is $5,790,975.04 (HSTI) including the option periods.	
    
    3.	Criteria for Assessment of the Statement of Capabilities  
    
    Any interested supplier must clearly demonstrate by way of a statement of capabilities how their proposed product meets each of the following requirements:
    
    Shared Services Canada requires the Automated Scheduling Software to be compliant with the following required functionalities:
    
    1. 	The solution must work and use data information to and from (interoperate
    	with) all of the following hosting platforms and ERP Applications:
    
    Operating systems:
    •	Unisys (MCP, OS2200)
    •	IBM  (MVS, I, Z/OS,Z/VSE,AIX)
    •	SUN Microsystems  (Unix all OS versions)
    •	Hewlett Packard (Unix all OS versions, HP  NONSTOP, HP OpenVMS)
    •	Microsoft (all OS versions)
    •	Linux (all vendors)
    •	Unix (All vendors)
    
    ERP Applications:
    •	SAP
    •	Baan
    •	Banner
    •	Lawson
    •	PeopleSoft
    •	JD Edwards
    
    Connectors:
    •	Amazon EC2
    •	BODS
    •	Database (MS SQL, SQL Generic)
    •	Java
    •	Microsoft Orchestrator
    •	Quartz
    •	Resource Monitoring
    •	SSH
    •	VMWare
    
    2. 	The solution must deliver, enable and support the functionality to prevent network intrusion and manipulation. 
    
    3. 	The solution must deliver, enable and support the functionality to schedule tasks on all O/S identified from a single schedule and automate and integrate the legacy OS system MCP (Unisys), All UNIX, All Microsoft and MVS (IBM) from one screen with one technology. 
    
    4. 	The solution must deliver, enable and support the functionality to perform encrypted file transfers between hosts that have a scheduling agent without the use of 3rd party software. The file transfer must also include a checkpoint restart and verification process to ensure that total file is transferred in its entirety prior to making  it available on the destination host for use by subsequent applications.
    
    5. 	The solution must deliver, enable and support the functionality to dynamically update the scheduler database using an XML formatted text file that is placed in a monitored directory.
    
    6. 	The solution must deliver, enable and support the functionality to address all aspects of automation from one technology, not many different tools tied together. 
    
    7. 	The solution must not require OS specific personnel to enable, deliver and support automation of tasks on the designated platform.
    
    8. 	The solution must deliver, enable and support an 'Event Driven' management component as an integral part of the technology to all actions to be taken upon a condition detected by automation process.
    
    9. 	The solution must deliver, enable and support the ability to monitor a web page and take an automated action based upon a condition.  
    
    10. 	The solution must work, use data information to and from (interoperate with) HRSDC's current technical infrastructure. Details surrounding this can be provided upon written request to the Contracting Authority named herein.  
    
    The software products are the only known software products that can meet all of the above mandatory requirements.  Software & Management Associates is the publisher of the proposed software products and the only known vendor that can satisfy the requirement for the reason of exclusive and proprietary rights.  
    
    Before awarding a contract, however, the government provides other suppliers with the opportunity to demonstrate that they are capable of satisfying the requirements set out in this Notice, by submitting a statement of capabilities during the fifteen (15) calendar day posting period.
    
    If other potential suppliers submit statements of capabilities during the fifteen (15) calendar day posting period that meet the requirements set out in this ACAN, the government will proceed to a full tendering process on either the government's electronic tendering service or through traditional means, in order to award the contract.
    If no other supplier submits, on or before the closing date, a statement of capabilities meeting the requirements set out in the ACAN, a contract will be awarded to the preselected supplier.  
    
    4.	Applicability of the trade agreement(s) to the procurement
    
    This procurement is subject to national security exception and is, therefore, excluded from all of the obligations of the trade agreements.
    
    
    On May 28, 2012, the Government of Canada announced on the Government Electronic Tendering Service that it had invoked the National Security Exception under the trade agreements in respect of procurements related to email, networks and data centres for Shared Services Canada.  As a result, this requirement is subject to the National Security Exception.
    
    5.	Justification for the Pre-Identified Supplier
    
    The only known supplier of an Automated Scheduling Software that meets all of the above required technical specifications is Software & Management Associates therefore it is proposed to negotiate this requirement with Software & Management Associates.
    
    6.	Exclusions and/or Limited Tendering Reasons
    
    The requirement is invoking limited tendering exception 6.(d) of the Government Contracts Regulations (GCRs) where only one person is capable of performing the contract. 
    
    7.	Period of the proposed contract or delivery date
    
    The software licenses will be delivered within 7 days of any resulting contract and no later than July 31, 2015. The Maintenance and Support Services will be provided for a period of nine (9) months from the date of contract award and include four (4) additional one (1) year option periods to extend the subscription and support.

    9.	Suppliers' right to submit a statement of capabilities
    
    Suppliers who consider themselves fully qualified and available to provide the goods and services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    10.	Closing date for a submission of a statement of capabilities
    
    The closing date and time for accepting statements of capabilities is June 17, 2015 at 2:00 p.m. EST.

    An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good or services to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award.  However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
    
    Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    The SSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any procurement.
    
    Documents may be submitted in either official language of Canada.
    Suppliers that have submitted a response will be notified in writing of SSC's decision to continue with the non-competitive procurement or to compete the requirement.
