ADVANCE CONTRACT AWARD NOTICE (ACAN) 1. Title SmartDriver for Highway Trucking Training Pilot 2. Definition An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the competitive requirements of the government's contracting policy have been met. Following notification to suppliers not successful in demonstrating that their Statement of Capabilities meets the requirements set out in the ACAN, the contract may then be awarded using the Treasury Board's electronic bidding authorities. If other potential suppliers submit Statement of Capabilities during the fifteen calendar day posting period, and meet the requirements set out in the ACAN, the department or agency must proceed to a full tendering process on either the government's electronic tendering service or through traditional means, in order to award the contract. 3. Definition of Requirement Natural Resources Canada (NRCan)’s ecoENERGY Efficiency for Vehicles’ (FleetSmart) introduces on-road Canadian fleets free advice on energy-efficient business practices and vehicles to reduce fuel consumption, greenhouse gas emissions and operations costs, to increase productivity and competitiveness. Within this mandate, FleetSmart offers SmartDriver for Highway Trucking (SDHT) training to teach professional operators fuel-efficient driving practices. SDHT has been redeveloped into an electronic/web-based curriculum to meet the industry’s growing demand for efficient drivers of heavy-duty tractor-trailers. Its new design allows online learning, classroom training and on-road practice and trainers to tailor the content based on the type of training required. The purpose of this contract is to engage the Saskatchewan Trucking Association in the promotion and delivery of new SDHT training to its membership of professional fleet drivers, owner-operators and fleet managers. DELIVERABLES The Saskatchewan Trucking Association will be responsible for the coordination and management of the following project deliverables: Deliverable 1 – Provincial Industry Awareness and Membership Engagement Raise awareness of SDHT throughout the province by promoting the benefits of energy-efficient training sessions to the Saskatchewan Trucking Association members and others within the trucking industry via web sites, newsletters, mail-outs and other trucking activities. Deliverable 2 – SDHT On-Line and Classroom Training Coordinate and deliver SDHT on-line and/or classroom training, to “bundles” of 15 participants, using approved administrators, appropriate facilities and qualified trainers. Distribute, collect and report on all pre and post-course surveys, Certificate of Achievement tests and course evaluations from all classroom sessions. Deliverable 3 – Participant Follow-up Survey Complete participant survey six (6) months after training, compile results and report back to NRCan in order to assist in the assessment of individual performance and the overall impact of SDHT training. Note: This deliverable will require the creation of an appropriate Excel spreadsheet for the capture of participant data, subsequent follow-up and final reporting. Also, if training is delivered with less than 6 months remaining in the contract, the completion of this deliverable 3 is unrequired. 4. Trade Agreements Applicable Limited Tendering Provision under NAFTA (Article 1016.2) 1016.2(b) - where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists; Applicable Limited Tendering Provision under AIT (Article 506.12) 506.12(a) - to ensure compatibility with existing products, to recognize exclusive rights, such as exclusive licenses, copyright and patent rights, or to maintain specialized products that must be maintained by the manufacturer or its representative Applicable Limited Tendering Provision under WTO-AGP (Article XV.1) XV.1 (a) - protection of exclusive rights, such as patents or copyrights, or in the absence of competition for technical reasons, the products or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists 5. Title to Intellectual property This procurement action will not result in the development of any intellectual property. 6. Contract Period The contract shall begin upon contract award and end March 15, 2016. 7. Estimated Cost The estimated maximum value of the contract is $32,625.00 CAD, plus all applicable taxes. 8. Exception to the Government Contracts Regulations and applicable trade agreements Sole Source Justification Exception of the Government Contract Regulations (GCR): (d) Only one person or firm is capable of performing the contract Provincial trucking associations are the responsible voice of the road transportation industry, representing all segments of the industry (for-hire carriers, private carriers, intermodal, suppliers, etc.). Trucking associations offer an array of literature, education programs, training materials and on-line tools to help executives and drivers stay up-to-date on the ever-changing industry and are well-established and able to network and promote initiatives within Canadian jurisdictions at minimal to no expense. The Saskatchewan Trucking Association is the only association representing Saskatchewan. There are a total of 7 trucking associations across Canada (Ontario, Quebec, Atlantic, Manitoba, Alberta, Saskatchewan, and British Columbia). 9. Inquiries on Submission of Statement of Capabilities Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a Statement of Capabilities in writing, preferably by e-mail, to the contact person identified in this Notice on or before the closing date and time of this Notice. The Statement of Capabilities must clearly demonstrate how the supplier meets the advertised requirements. 11. Closing Date The closing date for submitting statements of capabilities is July 29, 2015 at 2:00 PM EST. 12.
