    Advanced Contract Award Notice (ACAN) for:

    INAC – Yellowknife Metropolitan Network Services (Dark Fibre)

    1. What is an ACAN: An ACAN is a public notice indicating to the supplier community that adepartment or agency intends to award a contract for goods, services or construction to apre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities thatmeets the requirements set out in the ACAN, on or before the closing date stated for in the ACAN, the contracting officer may then proceed with the award of a contract.

    2. NSE Invocation: On May 28, 2012, the Government of Canada announced on the Government Electronic Tendering Service that it had invoked the National Security Exception under the trade agreements in respect of procurements related to email, networks and data centres for Shared Services Canada. As a result, this requirement is subject to the National Security Exception.

    3. Definition of requirement: Shared Services Canada (SSC) has a requirement for the procurement of a Metropolitan Area Network (MAN) fibre backbone in Yellowknife for Indigenous and Northern Affairs Canada (INAC). The purpose of this Advance Contract Award Notice (ACAN) is to signal the government's intention to award a contract for these services to Ardicom Digital Communications Inc., who is the only known firm capable of performing the contract.

    4. Period of the proposed contract and required service delivery: The Contract period will be for a period of 5 years. Delivery of services to commence immediately upon notification of contract award.

    5. Government Contracts Regulations Exception and Limited Tendering Reason: It is Canada’s intention to direct a Contract in accordance with exception Section 6 (d) of the Government Contracts Regulations that states that, “only one person or firm is capable of performing this contract.”

    6. Cost estimate of the proposed contract: The Total Estimated Cost of this contract is $650,000.00, applicable taxes excluded.

    8. Suppliers' right to submit a statement of capabilities: Suppliers who consider themselves fully qualified and available to provide the services described herein, may submit a Statement of Capabilities in writing to the contact person identified below on or before the closing date ofthis notice. The statement of capabilities must clearly demonstrate how the supplier meets theMinimum Essential Requirements listed below.

    9. Minimum Essential Requirements: Any interested supplier must demonstrate by way of a Statement of Capabilities that it can meet the following minimum essential requirements:

    1. Meet all the requirements as specified in Annex A - Statement of Work;
    2. The Supplier must demonstrate it has provided dark fibre services to large enterprises/GoC in the Yellowknife, Nunavut, NT, and Yukon by providing at least 1 Project Summary.

    The Project Summary must, at a minimum, contain the following information:

    • Company Name, Contact Name and phone number, and a brief summary of the services, and length of services, provided.

    C. The Supplier must demonstrate that it has the proper equipment and capacity to support, troubleshoot, repair and maintain the services described in this statement of work by providing at least 1 Project Summary.

    The Project Summary must, at a minimum, contain the following information:

    • Company Name, Contact Name and phone number, and a brief summary of the service provided;
    • Details of equipment used to provide the services;
    • Number of available full-time technicians to provide maintenance and support in the event of a failure; and
    • Confirmation that it can meet the Service Levels described in this Statement of Work.

    10. If a potential supplier submits a statement of capabilities during the posting period that meetsthe requirements set out in this ACAN, the government will proceed to a full tendering process oneither the government's electronic tendering system or through traditional means in order to award the contract.

    If no other supplier submits on or before the closing date a statement of capabilities meeting the requirements set out in this ACAN, a contract will be awarded to the pre-selected supplier.

    11. Security requirement:

    11.1 The contractor and/or its employees must EACH maintain a valid RELIABILITY STATUS, granted by Canada and approved by Shared Services Canada.

    11.2 The contractor and/or its employees MUST NOT remove any PROTECTED and/or CLASSIFIED information or assets from the identified work site(s).

    11.3 The contractor and/or its employees MUST NOT use its IT systems to electronically process, produce or store PROTECTED and/or CLASSIFIED information or data.

    11.4 Subcontracts which contain security requirements are NOT to be awarded without the prior written permission of Shared Services Canada.

    11.5 The contractor and its employees must comply with the provisions of the:

    A) Justice Canada – Security of Information Act (Latest Edition);

    B) Industrial Security Manual (Latest Edition).

    12. The closing date and time for accepting statements of capabilities is:

    • December 23, 2015 @ 12:00 PM EST

    Only Suppliers that have submitted a response will be notified in writing of SSC’s resulting decision to continue with a competitive or non-competitive procurement.

    13. This procurement is subject to the following CLCA:
