    ADVANCE CONTRACT AWARD NOTICE (ACAN)

    An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, during the fifteen calendar day posting period, a statement of capabilities that meet the requirements set out in the ACAN, the competitive requirements of the government's contracting policy have been met. Following notification to suppliers not successful in demonstrating that their statement of capabilities meets the requirements set out in the ACAN, the contract may then be awarded using the Treasury Board's electronic bidding authorities.

    If other potential suppliers submit statements of capabilities during the fifteen calendar day posting period, and meet the requirements set out in the ACAN, the department or agency must proceed to a full tendering process on either the government's electronic tendering service or through traditional means, in order to award the contract.

    DESCRIPTIVE TITLE:

    Upgrade to Existing Crane Structure (Bridge & Hoist)

    BACKGROUND

    Measurement Canada (MC) recently replaced an old equal arm balance with an electronic comparator. Subsection 13(2) of the Weights and Measures Act requires that every local standard be calibrated and certified within periods of time as may be prescribed. The crane equipment and structure is inspected and certified annually by an accredited third party ensuring operational and safety measures are in place. To carry out this core mandate, it has become necessary to upgrade to ensure safe handling by those operating the equipment. In doing so, the support structure (crane bridge & hoist) must be upgraded to withstand 2000kg weight at the hook extremity.

    REQUIREMENTS/RESULTS:

    In order to keep the integrity and not compromise the existing system without having to replace the entire bridge and support system (at a much higher cost), MC requires to upgrade the existing crane system to increase its strength capacity from 1000kg to 2000kg.

    The crane/bridge upgrade will include a tractor drive allowing operator to move the weights in six directions (up/down, back/forth, left/right) from its current two positions (up/down) with a manual push/pull force; and hoist by adding bi-directional movement for safe handling of the weights used in calibrations.

    Consequently, the work must be completed by the original supplier who engineered the custom structure to fit the lab and original requirements. This upgrade provides longevity to the Crane system/structure with minimal cost and assists to carry out MC’s mandate without further foreseeable upgrades.(See attached pictures of crane system/structure).

    REASON FOR AWARDING CONTRACT TO THIS CONTRACTOR

    Exception (d) sets competitive bidding aside when only one person or firm can do the job. This exception is quite definitive and should be invoked only where patent or copyright requirements, or technical compatibility factors and technological expertise suggest that only one contractor exists. This exception should not be invoked simply because a proposed contractor is the only one known to management.

    Upgrade to the existing crane system is required to increase its strength capacity from 1000kg to 2000kg to keep the integrity and not compromise the existing system without having to replace the entire bridge and support system. This upgrade provides longevity to the Crane system/structure with minimal cost and assists to carry out MC’s mandate without further foreseeable upgrades.

    MC will not be able to fulfill its duties under Subsection 13(2) of the Weights and Measures Act as the current setup does not allow MC staff to use the mass comparators in a safe and efficient manner.

    Due to the specialized nature of the work performed by Inspectors during the calibration process no other alternative solutions or other options are available. Work cannot be done in-house as it requires reinforcement of an existing structure to increase capacity and safe handling of weights to be calibrated and to meet Electrical Safety Authority (ESA), Ontario approval.

    ESTIMATED COST

    The period of the contract will be from 01/04/2016 to 03/25/2016 and the total amount of the contract is estimated to be $52,658.00, including taxes.

    Section 6(d) of the Government Contracts Regulations is being invoked in this procurement as only one person or firm is believed capable of performing the contract.
