ADVANCE CONTRACT AWARD NOTICE (ACAN)
Definition
An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the competitive requirements of the government's contracting policy have been met. Following notification to suppliers not successful in demonstrating that their Statement of Capabilities meets the requirements set out in the ACAN, the contract may then be awarded using the Treasury Board's electronic bidding authorities.
If other potential suppliers submit Statement of Capabilities during the fifteen calendar day posting period, and meet the requirements set out in the ACAN, the department or agency must proceed to a full tendering process on either the government's electronic tendering service or through traditional means, in order to award the contract.
Definition of Requirements
Background:
Natural Resources Canada (NRCan) has entered into a partnership with the Canadian Museum of Nature (CMN) to collaborate on the curation and management of the National Geological Reference Collection (NGRC). To improve curation and space use effectiveness, there are 429 Lane scientific cabinets purchased by NRCan for rehousing the National Geological Reference Collection at the Canadian Museum of Nature located on Pink Road, Gatineau, Québec.
Objective:
There are 3 phases to the scope of work which include;
- securing 429 Lane Scientific cabinets (currently stored in storage spaces throughout the Canadian Museum of Nature research facilities) onto a previously installed Montel specialized rail carriage located in warehouse #2;
- designing custom brackets and rivet systems to secure the cabinets onto the rail carriage system; and
- securing the cabinets onto the carriage system and against each other to Montel engineering placement specifications to ensure a balanced floor load and no weight shift as well as to meet the room specifications of layout and cabinet accessibility for curation management.
The Contractor must be able to rapidly determine (in situ) the design and specifications to ensure the safe operation of the mobile system with the cabinets.
The proposed Contractor specializes in compact storage solutions for geology, paleontology and botany cabinets for storing natural science specimens such as plant fossils, rocks and minerals and specialization of this nature is critical to fulfilling this requirement. The Canadian Museum of Nature uses these systems and this company for installing their cabinets at their curation facilities.

Contract Period
From award of contract to July 29, 2016.
Estimated Cost
Estimated cost is $35,000 inclusive of taxes.
Exception to the Government Contracts Regulations and applicable trade agreements
In accordance with the Government Contract Regulations (GCR) exception, Part 1, Section 6, (d) only one person or firm is capable of performing the contract.
Montel is the exclusive service supplier for the Canadian Museum of Nature for all railing and carriage systems and the only one authorized by CMN to provide such services. Montel must be used for additional deliveries by the original supplier that are intended either as replacement parts or continuing services for existing supplies, services or installations, or as the extension of existing supplies, services or installations, where a change of supplier would compel the entity to procure equipment or services not meeting requirements of interchangeability with already existing equipment or services.
Montel is the only provider that can meet the requirement as detailed under the Definition of Requirement (paragraph 2)
