Advance Contract Award Notice (ACAN)
- Definition
An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the competitive requirements of the government's contracting policy have been met. Following notification to suppliers not successful in demonstrating that their Statement of Capabilities meets the requirements set out in the ACAN, the contract may then be awarded using the Treasury Board's electronic bidding authorities.
If other potential suppliers submit Statement of Capabilities during the fifteen calendar day posting period, and meet the requirements set out in the ACAN, the department or agency must proceed to a full tendering process on either the government's electronic tendering service or through traditional means, in order to award the contract.
2. Definition of Requirements
The tasks associated with this project include:
- Securely obtain annual Canadian wind farm production and availability data from the Canadian wind industry
- Publish details on the number of wind farms reporting, reporting year, locations, aggregated capacity, and similar computations.
- Work collaboratively with industry partners, researchers and contributors to define research objectives on an annual basis
- Execute research objectives, and publish reports of the analyses and findings
- Provide aggregated datasets to NRCan researchers
3. Criteria for Assessment of the Statement of Capabilities
Any Interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements.
The provider must:
- have an agreement with the Canadian Wind Energy Association (CanWEA) and wind plant owners for the collection, aggregation, analysis, and dissemination of data from wind turbine owners.
- own and operate a wind farm, and contribute data and research to the analysis of wind farm production and availability data from their own operations, and be in receipt of data from other wind farms
- be engaged with the Canadian wind industry, and have signed appropriate non-disclosure agreements (NDAs) in order to receive, maintain, aggregate and analyze proprietary data that would otherwise not be publicly available
- be able to provide a third party independent analysis of wind farm data, and agree to use the data only for research purposes
- have undertaken similar research in the past, and continues to pursue research involving wind farm availability and production data
- have technical expertise in Canadian wind energy research and development.
4. Trade Agreements
Proposed procurement is subject to North American Free Trade Agreement (NAFTA).
5. Justification for the Pre-Identified Supplier
We intend to deal directly with the supplier mentioned in section 11 below as it is the only known supplier that meets the mandatory criteria set out in section 3 above.
6. Exception to the Government Contracts Regulations and applicable
The Government Contracts Regulations (GCRs Section 6) exception to soliciting bids. 6.(d)only one person or firm is capable of performing the contract.
The proposed supplier, Wind Energy Institute of Canada, is the sole supplier that meets all of the criteria in section 3 above.
7. Exclusions and/or Limited Tendering Reasons
The following exclusion and/or limited tendering reasons are invoked under the:
North American Free Trade Agreement Article 1016.2 (b)
8. Title to Intellectual property
Title to Intellectual property created during the course of the contract, will belong to the crown for reason of: to generate knowledge and information for public dissemination.
9. Contract Period
This contract will span from March 2017 to March 2018, with the possibility of two option years.
10. Estimated Cost
The estimated maximum value of the contract is $90,400.00 CAD, taxes included.

12. Inquiries on Submission of Statement of Capabilities
Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a Statement of Capabilities in writing, preferably by e-mail, to the contact person identified in this Notice on or before the closing date and time of this Notice. The Statement of Capabilities must clearly demonstrate how the supplier meets the advertised requirements.
13. Closing Date
The closing date and time for accepting Statements of Capabilities, is 1400 Pacific Standard Time, March 7, 2017.
