Advanced Contract Award Notice (16-22161) - Illumina Maintenance Agreement:

Advance Contract Award Notice (ACAN): An ACAN is a public notice indicating to the supplier community that the National Research Council Canada intends to award a contract to a turn-key service provider for the repair and maintenance of our oversize legacy compressor systems. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the NRC will proceed with the award to the pre-identified supplier.

Requirement: The National Research Council Canada has a requirement for a preventive maintenance contract for a suite of Sequencers that were manufactured by illumina instruments. The contractor will be responsible for technical support including full coverage of parts, labor and travel. The agreement includes 3 visits on-site to upgrade hardware, software, and on-site applications such as training, calibration and full service balancing.

The contractor will be responsible to service the following instruments:

- Four (x4) illumina HiSeq 2500, Model Sv-402-1003 and one (x1) illumina MidSeq 2500, Model Sv-420-1003.

Justification for the Pre-Identified Supplier:
The National Research Council Canada wishes to award a preventive maintenance agreement to illumina instruments. illumina instruments is the original designer of NRC's equipment. illumina technicians and engineers are factory trained according to (OEM) standards. illumina instruments offers a unique turn-key service agreement and illumina is the original inventor of the equipment in question and holds all right to the intellectual property designs.

Government Contracts Regulations Exception(s):
The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection: 6(d) - "only one person is capable of NRC needs for techincal reasons.

Exclusions and/or Limited Tendering Reasons: 1016b
Where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists.

The following exclusion(s) and/or limited tendering reasons are invoked under the:

• (WTO-AGP) Article(s) (CAP Code 71) and (NAFTA) – Article(s) (CAP Code 71)

Period of the proposed contract or delivery date:
The estimated Contract is for a One year period (Plus two, One-year Optional periods). These dates are subject to negotiation and maybe subject to change depending on (NRC)’s business needs.

Cost estimate of the Standing Offer Agreement - $300,000 - $900,000 CAD.

Suppliers' right to submit a statement of capabilities:
Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
