Advance Contract Award Notice
- An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities.
If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
2. Definition of the requirement
The Contractor must provide two (2) three-day Contract Management for Ship Construction, Repair, & Design, a lessons-learned course to a group of employees of the Canadian Federal Government.
The Department of Public Services and Procurement Canada has a requirement to the Government of Canada established the National Shipbuilding Strategy (NSS) to meet Canada’s shipbuilding requirements including construction of both large and small ships, as well as for ship repair, refit and maintenance. Since then, Canada’s shipbuilding efforts have significantly increased, leading to the need for specialized training for employees in ship construction, repair and design.
The work will involve the following:
The Contractor is to conduct the two (2) 3-day Training Program entitled Contract Management for Ship Construction, Repair and Design, to be held at Place du Portage Phase III, in Gatineau, PQ. This training will provide the opportunity for 25 employees of the Canadian Federal Government who are involved in negotiating ship design, build, repair, overhaul, maintenance, and/or disposal contracts to learn and discuss the complex elements specific to contracting in the shipbuilding industry. The training is based on decades of lessons learned by experienced industry experts. Instead of a theoretical course on contract management, the program is based upon the "scar tissue" from marine contractual disasters.
Topics include: Project Formation Utilizing Principles of Contract Management; Negotiating, Pricing and Scheduling; and, Project Control Through Application of Principles and Proven Techniques. All training and materials are to be provided in English only. Please note that Canada will not be providing any food or drink to the Contractor or attendees. Prices are to include professional fees, transportation and hotel for the instructor.
3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)
Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:

Experience;
- At least 20 years’ experience in the last 25 years providing training to groups of 15-25 people in contract management for ship construction, design and repair. Training must have been provided to governments and commercial industry.
- At least 20 years’ experience in the last 25 years of providing advice to a combination of ship designers, insurers, owners, repairers and shipbuilders regarding technical, cost and schedule issues in shipbuilding and ship repair, including: project management, liability, dispute resolution, and the preparation of shipbuilding bids and contracts. This experience must be drawn from both commercial and naval environments.

Knowledge and understanding of;
- Extensive knowledge in the field of shipbuilding (design and build), project management, litigation, ship repair (overhaul, maintenance), and contract management as evidenced through a minimum of 25 years of experience in this field.

Academic qualifications
- Must possess, at a minimum, a master’s degree in Naval Architecture

Professional designation, accreditation, and/or certification
- Must hold a certification in Admiralty and Maritime Law.

5. Justification for the Pre-Identified Supplier
This is the only known supplier for this specific training, which is required by Canada. This is specialized training for a specific function, which is not offered through any other known means. Fisher Maritime's Contract Management for Ship Construction, Repair, & Design is a lessons-learned course geared to those involved in vessel construction, repair, and design. Instead of a theoretical course on contract management, the program is based upon the "scar tissue" from marine contractual disasters. Note that the supplier's course notebook is copyrighted and recording of the program is prohibited.
6. Government Contracts Regulations Exception(s)
The following exception(s) to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work".

8. Period of the proposed contract or delivery date
The two (2) courses must be delivered onsite, the first one from October 31 to November 2, 2017, the second one to be scheduled later but still under the same contract ending October 31, 2018. There is a possibility of two (2) one (1) year options if need be for one (1) or two (2) more on site three (3) day courses per possible option year.
9. Cost estimate of the proposed contract
The estimated value of the contract is $141,610.00 USD, applicable taxes extra.

11. Suppliers' right to submit a statement of capabilities
Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
12. Closing date for a submission of a statement of capabilities
The closing date and time for accepting statements of capabilities is September 8, 2017 at 2:00 p.m. EDT.
