ADVANCE CONTRACT AWARD NOTICE
Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities.
If no other supplier submits, on or before the closing date, a statement of capabilities that meets the requirements set out in the ACAN, the competitive requirements of the government’s contracting policy have been met.
Following notification to suppliers not successful in demonstrating that their statement of capabilities meets the requirements set out in the ACAN, the contract may then be awarded using the Treasury Board electronic bidding authorities.
If other potential suppliers submit statements of capabilities during the twenty one (21) calendar days posting period, and meet the requirements set out in the ACAN, the department or agency must proceed to a full tendering process on either the government’s electronic tendering service or through traditional means, in order to award the contract.
Definition of Requirements
Transport Canada has a requirement for an investigation into, analysis of and reporting on the modeling of a UN (UN-T75) portable tank (also called an “ISO tank”) which is carrying liquefied natural gas (LNG) and exposed to fire.
The work will require the Contractor to adapt an existing model which will be capable of simulating UN portable tank behaviour in the case of full fire exposure (i.e., the UN portable tank filled with cryogenic liquid placed directly into pool fire conditions for a time period of over 60 minutes). The model is also required to be capable of modeling the behaviour of the cryogenic liquid inside the tank in the case of full fire exposure.
The Contractor will then validate that model against actual data obtained from a full scale fire test wherein a UN portable tank containing a cryogenic flammable liquid was exposed to a “full scale fire test”. A full scale fire test means that an instrumented UN portable tank was exposed to pool fire conditions and specifically monitored to produce all data required to validate this model.
Transport Canada intends to include in any resultant contract options for expanding the investigation to include the predictive modeling of:
1. Effects of tank rupture;
2. Effects of ignition from PRV exhaust;
3. Predicting BLEVE events; or
4. Effects of rollover or crash conditions.
Criteria for Assessment of the Statement of Capabilities
The Contractor must meet the following qualifications;
- Have a model that incorporates the detailed UN portable tank geometry;
- Have a model that is capable of simulating phase change of a cryogenic liquid in containment; and
- Have access to all data from a full-scale fire testing of a full UN portable tank. Required data from full-scale fire testing includes: heat flux to UN portable tank, flow rate through the pressure relief valve (PRV), volume of cryogenic fluid remaining in the UN portable tank over time, and internal pressure of the UN portable tank during full scale fire test.
Justification for Pre-Identified Supplier
The proposed supplier is the only known contractor that meets the above requirements.
Exclusions and/or Limited Tendering Reasons
The contract is proposed under the Government Contracting Regulations, Section 6 (d) that states “only one person or firm is capable of performing the contract”.
Ownership of Intellectual Property
Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor.
Contract Period
The proposed contract period will be from date of Contract Award to March 31, 2018. If the option is exercised, the period of performance will be to March 31, 2019.
Estimated Cost
The estimated maximum value of the proposed contract is $200,000.00 CAD, plus $200,000.00 CAD if the option is exercised for a total of $400,000.00, taxes included.

Suppliers’ Right to Submit a Statement of Capabilities
Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a Statement of Capabilities in writing, preferably by e-mail, to the contact person identified in this Notice on or before the closing date and time of this Notice. The Statement of Capabilities must clearly demonstrate how the supplier meets the advertised requirements.
Responses received on or before the closing date will be considered solely for the purpose of deciding whether or not to conduct a competitive procurement. Information provided will be used by the Crown for technical evaluation purposes only and is not to be construed as a competitive solicitation. Your written response must provide sufficient evidence (e.g. specifications, technical data, drawings, or any other proof) that clearly demonstrates that your product or service is capable of fulfilling this requirement.
Suppliers that have submitted a response will be notified in writing of TC’s decision to continue with the non-competitive procurement or to compete for the requirement.
Closing Date
The closing date for a submission of a Statement of Capabilities is September 12, 2017 at 2 p.m. Eastern Daylight Time (EDT).
