Promotion and distribution of OPC’s public education materials to schools across Canada
An Advanced Contract Award Notice (ACAN) is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meet the requirements set out in the ACAN, on or before the closing date and time stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
1. Definition of requirement
The Office of the Privacy Commissioner of Canada (OPC) intends to establish one (1) contract for the provision of supporting its public education mandate and strategies to reach youth at the national level by way of production, promotion and distribution of materials to 8,500 elementary schools across the country.
2. Background
The mission of the OPC is to protect and promote the privacy rights of individuals. The OPC has a specific mandate for public education in its legislation. The OPC is committed to enhancing privacy protections for various groups such as, but not limited to, youth, through public education and outreach. The OPC’s strategies to increase privacy education among youth include collaborating with teachers and encouraging privacy education and digital literacy in schools. The OPC would like to promote and distribute its public education materials aimed at youth to 8,500 elementary schools across Canada.
3. Objectives:
The OPC seeks to work with teachers to educate youth about privacy by promoting and distributing our public educational materials through elementary schools across Canada.
The work will involve printing a pre-approved poster and letter from the OPC, and then distributing those materials by mail to the supplier’s trusted list of school contacts, in every part of the country.
4. Tasks:
4.1 Produce and distribute posters and a letter
The supplier must clearly indicate that they have an existing, up-to-date database comprised of a minimum of 8,500 schools across Canada with grades 4, 5 and 6, with adequate representation in each province and territory and in both urban and rural areas. The supplier must demonstrate that the service will enable the OPC, through the distribution, to adequately reach English and French-speaking youth in schools across Canada.
- The OPC will provide the supplier with an approved poster design with dimensions of 17”x 22” that is to be printed in color on suitable paper stock. The artwork will be provided to the supplier and must be distributed to the schools before March 31, 2018. The OPC will provide a bilingual letter with dimensions of 8 ½”x 11” to the supplier. The letter will be printed by the supplier on paper stock.
- One (1) copy of the 8 ½”x 11” letter and one (1) copy of the poster will be put in a 9”x12” envelope for distribution, labelled with the contact information by the supplier. There will be a total of 8,500 packages.
- An additional 5,000 posters will be packaged in boxes and shipped to the OPC’s Gatineau headquarters.
4.2 Printing, handling/labelling, custom mailing list and distribution/postage
The supplier will print a total of 13,500 posters and 8,500 letters. The supplier will print and distribute 8,500 posters and 8,500 letters to accompany the posters to the schools across Canada. The remaining 5,000 posters will be shipped by the supplier to the OPC office (30 Victoria Street, Gatineau, QC, K1A 1H3). The supplier must provide printing, handling/labelling and distribution/postage of posters and letters to the 8,500 schools across Canada as well as for the shipment of the additional 5,000 posters to the OPC office.
5. Deliverables:
The contractor must:
5.1 Indicate that they have a database comprised of a minimum total of 8,500 schools with grades 4, 5 and 6 with adequate representation in each province and territory, in rural and urban areas and an ability to reach English and French-speaking youth across Canada. An established, trusted relationship between the supplier and the schools is required to ensure a willingness to actively use products from the supplier in their schools.
5.2 Produce and distribute posters and letters to a minimum of 8,500 schools across Canada. There will be 13,500 posters produced with 8,500 distributed to schools across Canada and 5,000 produced for the OPC. There will be 8,500 letters produced for each of the posters packaged to distribution.
5.3 Receive, handle and package for distribution, approximately 8,500 packages of one (1) poster and one (1) letter in a 9”x12” envelope to schools across Canada and 5,000 posters to the OPC. The packages must be in the possession of schools across Canada by March 31, 2018.
6. Criteria for assessment of the Statement of Capabilities: Minimum Essential Requirements
Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:
- Current list of schools across Canada:
- The contractor must possess an up-to-date database of a minimum of 8,500 schools in Canada that demonstrates the following:
- Market breakdown of provincial and territorial school locations (i.e., province, city, grades currently taught at the school, etc.)
- Clear demonstration of full market coverage in each province and territory, and in rural and urban areas
- Coverage of schools adequately reaching English and French-speaking Canadians
- Evidence of an existing, trusted relationship between the supplier and the contacts in the database, which would suggest to the OPC a willingness by the recipients to make active use of the materials.
- The contractor must possess an up-to-date database of a minimum of 8,500 schools in Canada that demonstrates the following:
- Production and distribution of posters and letters:
- The contractor must clearly demonstrate that they have the capacity and ability to print approximately 13,500 posters and 8,500 letters in color, on suitable paper stock within three (3) weeks of receiving a signed digital proof from the OPC. One (1) poster and one (1) letter will be packaged in a 9”x12” envelope and distributed to schools across Canada with grades 4, 5 and six in every province and territory and in both rural and urban areas. The remaining 5,000 posters must be shipped to the OPC office.
7. Applicability of the trade agreement (s) to the procurement
This procurement is not subject to any trade agreement.
8. Set-aside under the Procurement Strategy for Aboriginal Business
This procurement is not subject to any set-asides for Aboriginal Suppliers.
9. Comprehensive Land Claims Agreement (s)
This procurement is not subject to a Comprehensive Land Claims Agreement.
10. Justification for the Pre-Identified Supplier
The Canadian Teachers’ Federation (CTF) is the bilingual and national alliance of 17 teacher organizations representing over 238,000 teachers across Canada, in every province and territory and in both rural and urban areas. The CTF is in an optimal position to partner for this contract, as they have long-standing relationships with teachers and schools and material from this organization is well received and trusted by recipients. They also have the ability to discern which schools in each province and territory include grades 4 to 6.
11. Government Contracts Regulations Exception(s)
The following exception to the Government Contracts Regulations is invoked for this procurement under subsection:
Section 6d of the Government Contracts Regulations (only one person is capable of performing the contract).
12. Exclusions and/or Limited Tendering Reasons
The following exclusion (s) and/or limited tendering reasons are invoked under the section of the trade agreement (s) specified:
This procurement is not subject to any trade agreement.
13. Ownership of Intellectual Property
Canada intends to retain ownership of any Foreground Intellectual Property arising out of the proposed contract on the following basis:
- where the main purpose of the Crown Procurement Contract, or of the deliverables contracted for, is to generate knowledge and information for public dissemination.
14. The period of the proposed contract or the delivery date(s)
The period of the proposed contract is from award of contract date to March 31st, 2018. Distribution of materials as described in Section 4 – Tasks, must be completed by March 31, 2018.
15. A cost estimate of the proposed contract
The estimated value of the contract is approximately $30,000.00 (GST/HST excluded).

Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN, may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date and time of this notice. This statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
18. The closing date and time for a submission of a statement of capabilities
