Solicitation Number – 17-22129 (A) – Illumina Maintenance Agreement for Sequencers
An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre‑identified contractor. If no other supplier submits, on or before the closing date, a statement of capabilities that meets the requirements set out in the ACAN, the competitive requirements of the government’s contracting policy have been met. Following notification to suppliers not successful in demonstrating that their statement of capabilities meets the requirements set out in the ACAN, the contract may then be awarded using the Treasury Board’s electronic bidding authorities. If other potential suppliers submit statements of capabilities during the fifteen calendar day posting period, and meet the requirements set out in the ACAN, the department or agency must proceed to a full tendering process on either the government’s electronic tendering service or through traditional means, in order to award the contract.
The National Research Council wishes to award a maintenance agreement for a number of our IIIumia instruments including three Ultra High throughput sequencers and a number of our cBot automated systems. The agreement will be directed to the Original Equipment Manufacturer of the equipment “Illumina Inc as they are the “OEM” and the only source of supplier that’s capable of fulling NRC technical requirements for on-going repair and maintenance.
It is not feasible to compete this requirement through open competition as there exist sole source issues that only one vendor can address (interchangeability of OEM parts and components, data compatibility, OEM software and certified OEM technicians).
Provisions in accordance with the Government Contracts Regulations - only one person or firm are capable of performing the contract.
1016.2 (d) - for additional deliveries by the original supplier that are intended either as replacement parts or continuing services for existing supplies, services or installations, or as the
extension of existing supplies, services or installations, where a change of supplier would compel the entity to procure equipment or services not meeting requirements of interchangeability with already existing equipment or services, including software to the extent that the initial procurement of
the software.

Contract duration is to commence upon contract signature and terminate one year after the fact.
Contract may be subject to negotiation with the supplier.
Contract Value for one year - $300,000.00 USD
There is an option to renew at NRC’s discretion for two subsequent one-year periods
Contract Value including the optional Years - ($900,000 USD)
IP: There is no IP involved with this contract.
Suppliers who consider themselves fully qualified and available to provide the services/goods described herein (including the interdependency criteria from a scheduling perspective with other work being done internally that results in, as well as impacts, the timeline alluded to above), as well as with the necessary expertise and appropriate contacts with relevant and major global semiconductor memory device manufacturers for the associated critical market analyses (and understanding of paths to markets), may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets all of the advertised requirements.
Closing date for a submission of a statement of capabilities: February 15 2018, 2PM Eastern Standard time.
