    Description

    1. Advance Contract Award Notice (ACAN)

    An ACAN is a public notice indicating to the supplier community that a

    department or agency intends to award a contract for goods, services or

    construction to a pre-identified supplier, thereby allowing other suppliers to signal

    their interest in bidding, by submitting a statement of capabilities. If no supplier

    submits a statement of capabilities that meets the requirements set out in the

    ACAN, on or before the closing date stated in the ACAN, the contracting officer

    may then proceed with the award to the pre-identified supplier.

    2. Definition of Requirements

    The department of Natural Resources Canada (NRCan) has a requirement to

    renew support and maintenance fees for its Genesis-Kinex-Trinity 3D software

    licenses.

    Key requirements of this support and maintenance packages are listed below:

    • Comprehensive dedicated online tutorials that allow the novice user to

    rapidly acquire proficiency in the use of all software components and apply

    the technology to relevant geological and geochemical problems to

    produce rapid and meaningful results.

    • The online help should include downloadable example files as well as

    peripheral tools and datasets in T3 format to aid in the constraint of model

    boundary conditions e.g. global heat flow, global source rock distributions,

    Global CRUST 1.0 grids.

    • Personal 1on1 support given directly by the software developer, via

    telephone or by online web-collaborative tools such as GoToMeeting. The

    supporting software engineer will have a thorough and demonstrable

    understanding of the geological issues that can be addressed using the

    modeling software applications and comprehensive knowledge of proxy

    scenarios worldwide, with evidence of this through via international

    recognition of his or her expertise in this field of geotechnology.

    • Response time usually of <24hours from the logging of a non-superfluous

    issue with follow up support given as appropriate.

    • Rapid release of new functionality and debugging of reported issues with

    several new versions of each application (Genesis, Kinex, Trinity T3) per

    year to reflect the dynamic evolution of the user-requirements

    3. Criteria for Assessment of the Statement of Capabilities

    Any interested supplier must demonstrate by way of a statement of capabilities

    that its support system meets the following requirements in order to provide

    support for the Zetware Trinity T3 software suite including Genesis 1D burial

    history modeling and Kinex kerogen kinetic analysis applications:

    • The supplier must release new versions more than once per year of all basin modeling application components available to all users for download at the users’ convenience online via a secure, password-protected website
    • The new versions of the software must seamlessly accept (via drag and drop) and generate file formats compatible with other geological (GeoScout, AccuMap), geophysical (Geoframe, Kingdom Suite), and GIS (ArcGIS) applications currently used at NRCan.
    • Troubleshooting for software technical requirements and its geologicalapplicability must be available by direct telephone with a response time to resolve most issues of <48hours.
    • User issues must be addressed by the software developer and expert petroleum systems analyst (not separately) via either telephone or email.
    • For issues requiring real time support, this must be available by direct intervention to the users workstation using web-conferencing tools such as
    • GoToMeeting such that the issue can be clearly communicated directly to the software developer.

    4. Trade Agreements

    This procurement is subject to the following trade agreement(s):

    North America Free Trade Agreement (NAFTA);

    Canadian Free Trade Agreement (CFTA);

    5. Justification for the Pre-Identified Supplier

    We intend to deal directly with the supplier mentioned in section 11 below as, it is

    the only known supplier that meets the mandatory criteria set out in section 3

    above.

    Should Canada receive a statement of capabilities from a supplier that contains

    sufficient information to indicate that it meets the requirements set forth in this

    ACAN, a competitive process will be triggered with a technical and financial

    evaluation methodology of the bids proposed by the potential bidders

    6. Exception to the Government Contracts Regulations

    The following exception(s) to the Government Contracts Regulations is (are)

    invoked for this procurement under subsection :

    6(d) – only one person is capable of performing the work

    The identified provider, ZetaWare, is the only one able to meet all of the criteria

    identified in paragraph 3 above.

    7. Exclusions and/or Limited Tendering Reasons

    The following exclusion(s) and/or limited tendering reasons are invoked under

    the:

    North American Free Trade Agreement (NAFTA): Article 1016, 2, b

    Canadian Free Trade Agreement (CFTA): Article 513 b

    8. Ownership of Intellectual Property

    Ownership of any Foreground Intellectual Property arising out of the proposed

    contract will vest in the Contractor.

    9. Contract Period

    The contract period will be from March 1st, 2018 to February 28, 2019.

    Option for 3 years:

    1. from March 1st, 2019 to February 28, 2020

    2. from March 1st, 2020 to February 28, 2021

    3. from March 1st, 2021 to February 28, 2022

    10. Estimated Cost

    The estimated value of the firm price is $ 50,000.00 CAD taxes included.

    The estimated value of the optional years price is $150,000.00 CAD taxes

    included.

    For a total estimated value of $ 200,000.00 CAD taxes included.

    12. Suppliers’ right to submit a statement of capabilities

    Suppliers who consider themselves fully qualified and available to provide the

    services/goods described herein, may submit a Statement of Capabilities in

    writing, preferably by e-mail, to the contact person identified in this Notice on or

    before the closing date and time of this Notice. The Statement of Capabilities

    must clearly demonstrate how the supplier meets the advertised requirements.

    13. Closing Date

    The closing date for a submission of a Statement of Capabilities is February 21,

    2018 at 14:00 Eastern Standard Time.
