Description
An advanced contract award notice (ACAN) is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date and time stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
1. Definition of requirement:
1. Background
Correctional Service Canada (CSC) is an agency within the portfolio of Public Safety. The portfolio brings together key federal government organizations involved in public safety, including the Royal Canadian Mounted Police, the National Parole Board, the Canada Border Services Agency, the Canadian Security Intelligence Service, and three review bodies.
CSC contributes to public safety through the custody and reintegration of offenders. Specifically, CSC is responsible for administering court-imposed sentences for offenders sentenced to two (2) years or more.
CORCAN is a special operating agency of the Correctional Service of Canada. CORCAN is an organization with the primary objective of providing marketable employment skills training, counseling and employment support services to federally sentenced offenders to facilitate their successful re-integration into society.
CORCAN Construction is foremost an offender rehabilitation/training program with a comprehensive education, skills enhancement and work experience program established to prepare offenders for post-release employment in the construction industry.
CORCAN Construction takes the role and responsibility of a General Contractor to work on CSC construction projects.
2. Objective
CORCAN Construction requires the provision of an Offender Masonry Instructor required for a re-pointing construction project located in the Province of Alberta, in accordance with the Statement of Work herein.
3. Scope
The scope of the construction project is a combination of new construction and renovation of existing infrastructure in a correctional setting. The project will take place at Bowden Medium Security Institution at Bowden Alberta. The Work involves:
- Providing offender instruction and undertaking apprenticing lead duties instructing offenders in masonry and general construction skills; and
- Provision of a Mason Apprentice Instructors to lead offender workers which are required to undertake a re-pointing project located at Bowden Institution in the Province of Alberta, in accordance with the statement of work herein;
- Masonry Instruction and related services must be performed to the satisfaction of the Project Authority at the Bowden Institution where the work is to be performed during the period of the contract.
- Mason Apprentice Instructors serve as role models and have a transformative impact on offender behavior by showing the value of working hard and producing quality construction products and services.
4. Tasks and Responsibilities
Services shall be provided under the Contract on an as-and-when requested basis. It is estimated that this project will endure for up to 4500 masonry work hours or until the project is completed. A Task Authorization (TA) will be utilized to request tasks during the life of this contract. The tasks the Contractor must perform include, but are not limited to the following:
- As an Offender Instructor:
- Provide and coordinate the instruction of semi-skilled and unskilled offenders in day-to-day construction activities and techniques; monitor and pass on skills, knowledge and expertise in construction services to offenders in a correctional environment;
- Observe offenders in a “real world” work environment and assess how well they have integrated the skills they have developed through correctional programs;
- Ensure that the offenders meet the requirements of their Work Agreement (to be provided) which sets out the employability skills they are seeking to assimilate;
- Produce and maintain attendance records and report on performance of the offenders working on the site to Site Supervisor or Project Authority;
- Provide information on an as required basis to Security and Case management staff as it relates to the security of the site and the offenders participating in the program;
- Provide planning, scheduling, expediting, technical coordination and supervision necessary for execution of work by offenders as may be required on individual projects;
- Participate and complete security searches and security observation reports on an as required basis;
- Ensure all applicable safety requirements are followed as defined in the CORCAN Construction Site Safety Manual and Federal (Canada Labour Code) and, Provincial (per provincial standards) legislation, including any specific contractual and/or institutional regulations and PWGSC Guidelines; and attend site meetings, as required;
- Ensure that all work performed by offenders is in compliance with applicable provincial or national building codes;
- Ensure that all security requirements in regards to safe keeping of tools and other site related equipment are met;
- Provides daily or weekly (as required) updates to the Site Supervisor and/or Project Authority with the site progress regarding the various stages of completion and the meeting of deadlines as required;
- Maintain documentation (drawings, plans, specifications, etc.) at the site office for the specific project; (all drawings, plans and specifications are the property of the Project Authority and must not leave the project site without prior written approval from the Project Authority); and
- Identify site specific needs and work with the construction office to secure items and ensure that all materials delivered on site comply with requirements, specifications and quantity, and identify deficiencies to the Site Supervisor in a timely manner.
4.1 Nature of the Work and Additional Conditions
- The Contractor will receive its mandates from CSC / CORCAN Construction managers and the Project Authority;
- The Work pertains to a secure Government of Canada (GoC) construction environment;
- The Work may require climbing up and down ladders and scaffolding;
- The Work may require entry into confined and very restricted spaces;
Note: If required to enter onfined spaces, the Contractor must provide proof of having successfully completed training for work in confined spaces and first aid from a recognized organization. The Contractor must comply with prevailing entry procedures into confined or restricted spaces.
- Depending on the progress of ongoing CSC construction projects, it is possible that there are slack periods during which little or no Work will be required.
5. Deliverables:
Deliverables will be specified within each resulting Task Authorization (TA). The scope of work attached to each TA will identify the particular deliverable(s), tasks, and other relevant activities that are required to be implemented by the Contractor in the provision of services. Specific deliverables include, but are not limited to the following:
- Copies of their anticipated schedule at the beginning of each month
- Daily or weekly offender apprentice training attendance records for the offenders as prescribed by CSC /CORCAN
- Performance reports or evaluations for the offender workers supervised as required and as prescribed by CSC/CORCAN
- Information on security and case management staffing as it relates to the security of the site and the offenders participating in the program;
- Updates to the Site Supervisor and/or Project Authority regarding the various stages of completion and the meeting of deadlines as required.
6. Constraints
The following constraints must be taken into account in the performance of the Work as described in this document:
6.1 Language Requirements:
Consistent with the requirements of the Official Languages Act, the Contractor must communicate in the official language chosen by each CSC location, English or French, such that:
- Verbal communications with all CSC sites and personnel in a given Region are available in the preferred Official Language as indicated by that Region’s Language Profile.
- Written communications with all CSC sites and personnel in a given Region are available in the preferred Official Language as indicated by that Region’s Language Profile.
The Language Profile of any CSC Region in Canada indicates the Official Language or Languages used for the operation and service delivery of all Institutions and personnel. The Language Profiles for CSC Regions are as follows:

- All work deliverables must be completed in English.
- All meetings, telephone or teleconference discussions, email correspondence, and other communications with the PA must be conducted in English.
6.2 Documentation Requirements
The Contractor must provide documentation to the PA in the following formats:
- All proposals, reports, spreadsheets, and general communication documentation between the Contractor and the PA in a form compatible with Microsoft Office Suite.
6.3 Institutional Security/Lockdown
- The Contractor(s) must be aware that they may be faced with delay or refusal of entry to certain areas at certain times (e.g., institutional lockdown or other security related emergencies) even if prior arrangements for access may have been made.
- If necessary, the Contractor(s) is/are advised to call the Project Authority a minimum of 24 hours in advance of delivery to ensure that planned access is still available.
- If access is unavailable once they have arrived on-site, the Project Authority will advise the Contractor(s) on a workaround plan identified by the institution in question.
6.4 Institutional Operations
- The Contractor must be aware that CSC operates 24 hours per day, 7 days per week, and 365 days in managing the safety of the public, staff and federal offenders. The Contractor must take every precaution to minimize any disturbance to institutional operations. The Contractor and their staff on site must cooperate fully with operational staff and conform to all security requirements.
6.5 Contractor Requirements
In order to successfully carry out the Work the Contractor must comply with the following:
- The Contractor’s staff must hold a valid driver’s license;
- The Contractor’s staff must have at their disposal and carry with them all the personal protective equipment required in the performance of their Work; Tools and personal protective equipment must be authorized and inspected by the Project Authority
- At no time, will the contractor or their employees introduce tools to the site that are not first identified to the project authority and authorized and approved by the same.
7. Location of Work
- The location for work on this project is Bowden Institution located at Highway #2 P.O. Box 6000 Innisfail, Alberta
- The Contractor will be responsible for performing the Work and managing its personnel scheduling. This will require Contractor personnel to be on-site for some or all of the time the Work is underway. The travel and accommodations arrangements for the Contractor’s personnel engaged the Work is entirely the responsibility of the Contractor. No other travel is anticipated.
- Where feasible, communications between the PA and the Contractor will take place by telephone, email, or teleconference. The Contractor is expected to be available for such interactions with notice of two (2) business days.
8. Correctional Service Canada / CORCAN to provide
- All materials associated with individual projects, which will remain the property of the Crown upon completion;
- All tools and equipment required for the completion of projects and the training of offenders;
Note: If the Contractor supplies tools and equipment for the completion of the job, the Contractor must seek permission to utilize these tools in advance of introducing them in the medium security institution, ensure that all security requirements in regards to safe keeping of tools and other site related equipment are met, and must maintain the equipment;
- Administrative services and supplies directly associated with individual projects;
- Access to a landline telephone at the site office on Bowden Minimum Security grounds required for individual projects;
- Administration of all tendering and contract awards for goods and services required for the completion of individual projects; and
- Processing for payment all approved invoices for goods and services required for individual projects and for this contract.
9. Orientation Session
CSC will arrange for the Contractor selected to attend a project/site orientation session to clarify how the Work will proceed and give an understanding of CSC’s commitments and responsibilities in terms of construction projects.
10. Health and Safety
CSC has a duty to protect the health and ensure the safety of all persons employed on Crown construction projects. It also acknowledges that federal and private-sector employees are entitled to all of the protection provided for in occupational health and safety regulations.
In fulfillment of this commitment and in order to improve protection of the health and safety of all those working on federal construction sites, CSC has undertaken to comply with provincial and territorial laws and regulations on occupational health and safety, in addition to meeting the demands of Part II of the Canada Labour Code. In taking on the work, on-site consultants must:
- Meet the requirements of the Act Respecting Occupational Health and Safety, the Canada Labour Code, Part II, and their regulations;
- Depending on the work environment, have at their disposal and use the personal protective equipment (PPE) required by the prevailing standards, laws and regulations. Purchase and maintenance of the PPE is the consultant’s responsibility;
Note: The contractors’ employees may be refused entry to the work site if the appropriate PPE Equipment is not with them.
- Have in their possession a means of communication enabling them to respond to emergencies; Personal Portable Alarms may be issued by CSC or alternative protocols identified during site orientation;
- Ensure that they have safe means of transportation so that their health and safety are not compromised; and
- Be aware of their right to refuse any work that may endanger their health or safety and exercise that right when appropriate.
11. SECURITY REQUIREMENT FOR CANADIAN SUPPLIER:
- The Contractor/Offeror must, at all times during the performance of the Contract/Standing Offer, hold a valid Designated Organization Screening (DOS), issued by the Canadian Industrial Security Directorate (CISD), Public Works and Government Services Canada (PWGSC).
2. The Contractor/Offeror personnel requiring access to sensitive work site(s) must EACH hold a valid RELIABILITY STATUS, granted or approved by CISD/PWGSC.
3. Subcontracts which contain security requirements are NOT to be awarded without the prior written permission of CISD/PWGSC.
4. The Contractor/Offeror must comply with the provisions of the:
- Security Requirements Check List and security guide (if applicable), attached at Annex C;
- Industrial Security Manual (Latest Edition).
2. Criteria for assessing the statement of capabilities (minimum essential requirements):
Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:
- must present all appropriate licenses to perform masonry work in the Province of AB;
- must prove that it has been in business for at least the last five (5) years.;
- must provide proof indicating Journeyman staff who will work on-site have Journeyman qualifications; and
- Contractors to provide proof that Journeyman staff will have current certifications in: WHMIS, Safety Orientation, and Fall Arrest.
Journeyman Masons must have a minimum of seven (7) years recent work experience as a Journeyman Mason. As part of the seven years’ experience and must have a minimum of three (3) years leading and planning projects as a foreman. In addition, it must be clearly demonstrated and certificate of qualification with five (5) years’ minimum experience in historic brick masonry work.
Apprentice Masons must have a minimum of two (2) years training in commercial and/or industrial environment and eligible for certification as a Journeyman mason.
3. Applicability of the trade agreement (s) to the procurement
This procurement is subject to the following trade agreement (s):
Canadian Free Trade Agreement (CFTA);
4. Set-aside under the Procurement Strategy for Aboriginal Business
This procurement is not subject to any set-asides for Aboriginal Suppliers.
5. Comprehensive Land Claims Agreement (s)
This procurement is not subject to a Comprehensive Land Claims Agreement.
6. Justification for the Pre-Identified Supplier
Consultations with industry specialists have confirmed that mason skilled tradespersons are not available in this market. (Personnel companies; Vocational Training and placement agencies; PSPC officials) The open inventories have not produced a candidate that is willing to relocate to central Alberta for the duration of the assignment. The market labour rates are below the oil and gas industry average for that region.
Advantage Roofing Group has identified two skilled masons who are of indigenous heritage who would be willing and have an interest in undertaking this project. This is beneficial to Correctional Service of Canada as a large proportion of the offender population is of indigenous heritage and at Bowden Medium Security it is currently 31% (over 230 offenders) of the population.
The pre-identified supplier meets all of the minimum essential requirements described in this ACAN.
7. Government Contracts Regulations Exception(s)
The following exception to the Government Contracts Regulations is invoked for this procurement under subsection:
(d) only one person is capable of performing the contract.
8. Exclusions and/or Limited Tendering Reasons
Canadian Free Trade Agreement (CFTA), Article 513
(b) if the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute goods or services exist for any of the following reasons:
(i) the requirement is for a work of art;
(ii) the protection of patents, copyrights, or other exclusive rights;
(iii) due to an absence of competition for technical reasons;
(iv) the supply of goods or services is controlled by a supplier that is a statutory monopoly;
(v) to ensure compatibility with existing goods, or to maintain specialized goods that must be maintained by the manufacturer of those goods or its representative;
(vi) work is to be performed on property by a contractor according to provisions of a warranty or guarantee held in respect of the property or the original work;
(vii) work is to be performed on a leased building or related property, or portions thereof, that may be performed only by the lessor; or
(viii) the procurement is for subscriptions to newspapers, magazines, or other periodicals.
9. Ownership of Intellectual Property
There are no intellectual property terms in the contract.
10. Period of the proposed contract or the delivery date(s)
The proposed contract is for a period of from 5 Mar 2018 to 29 Sep 2019 with an option to extend the contract for 1 additional 1-year period.
11.Cost estimate of the proposed contract
The estimated value of the contract, including option(s), is $199,478.38 (GST/HST extra).
