    1. Advance Contract Award Notice

    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.

    2. Definition of the Requirement

    The Department of National Defence has a requirement to provide Avalanche Level 1 Training for Canadian Armed Forces members participating in back country ski mountaineering and avalanche training. Each training period will consist of 12 calendar days during the November and December timeframe, during which Avalanche Level 1 training will be required.

    A copy of the Statement of Work can be acquired through the contact in paragraph 13.

    3. Criteria for Assessment of the Statement of Capabilities (Minimum Essential Requirements)Any interested supplier must demonstrate by way of a statement of capabilities that it meets the Evaluation Criteria.

    a) Must be a CAA certified course provider;

    b) Must provide Level 1 Avalanche Training;

    c) Must provide qualified CAA Level 1 Avalanche instructors;

    d) Must conduct CAA standard avalanche and terrain safety assessment;

    e) Must provide both theoretical (classroom) and practical (outdoor field exercises) lessons;

    i. Nature of avalanches;

    ii. Hazards of avalanches;

    iii.Classify avalanche terrain;

    iv.Properties of the mountain snowpack;

    v. Describe, collect & record weather data;

    vi. Collect & record snowpack date;

    vii. Collect avalanche occurrence data;

    viii. State the factors and methods used in avalanche hazard evaluation;

    xi. Apply risk control methods;

    x. Conduct avalanche search and rescue; and

    xi. Describe the scope of practice for Level 1 ski operations.

    f) Instructors must be certified and approved by the CAA to teach Level 1 Avalanche Operations course.

    g) All instructors must have taught a minimum of four (4) Level 1 Avalanche Operations courses within the last five (5) years.

    4. Applicability of the trade agreement(s) to the procurement.

    This procurement is subject to the following trade agreements(s): North American Free Trade Agreement (NAFTA), the Canada-Chile Free Trade Agreement (CCFTA), World Trade Organization Agreement on Government Procurement (WTO-AGP), the Canadian Free Trade Agreement (CFTA), the Canada-Peru Free Trade Agreement (CPFTA), the Canada-Columbia Free Trade Agreement (CColFTA), the Canada-Panama Free Trade Agreement (CPanFTA), the Canada-Honduras Free Trade Agreement (CHFTA), and the Canada-Korea Free Trade Agreement (CKFTA).

    5. Justification for the Pre-Identified Supplier: 

    The Avalanche Operations training is currently known as the only certifying specialized training in Avalanche Search and Rescue Advanced Skills, Resource and Transportation Avalanche Management, Introduction to Weather, and Introduction to Snow Avalanche Mapping. The Canadian Avalanche Association (CAA) is the only recognized provider for certification for those working in the avalanche industry in positions such as Mountain and Ski Guiding, Ski Resort Avalanche Control Operations, Highway Avalanche Control Operations, etc.

    6. Government Contracts Regulations Exception:

    The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the contract."

    7. Exclusions and/or Limited Tendering Reasons

    The following exclusion(s) and/or limited tendering reasons are invoked under the:

    Canadian Free Trade Agreement (CFTA) 

     Articles 513(1)(a)(iii) and 513(1)(b)(iii);

     North American Free Trade Agreement (NAFTA)

     Article 1016(2)(b).

    8. Period of the proposed contract or delivery date:

    The proposed Standing Offer is for a period of three (3) initial years from the date of contract award with two (2) one-year option period.

    9. Cost estimate of the proposed Standing Offer:

    The estimated value of the Standing Offer including options, is $336,000.00 (applicable taxes included).

    11. Suppliers right to submit a statement of capabilities:

    Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.

    12. Closing date for a submission of a statement of capabilities:

    The closing date for accepting statement of capabilities is 17 October 2018, 1400hrs EDT.

    You are hereby notified that the government intends to negotiate with one firm only as identified above. Should you have any questions concerning this requirement, contact the Contracting Offer, identified above.

    An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than 15 calendar days, indicating to the supplier community that it intends to award a good, service or construction Standing Offer to a pre-identified contractor. If no other suppliers submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet requirements set out in the ACAN, the contracting authority will continue to a full tendering process.

    Suppliers who consider themselves fully qualified and available to provide the services/ goods described herein, may submit a Statement of Capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The Statement of Capabilities must clearly demonstrate how the supplier meets the advertised requirements.

    The Crown retains the right to negotiate with suppliers on any procurement.
