Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
Definition of the requirement
- The Department of National Defence has a requirement for the supply of quantity 12 Alternating Current Generators, Part Number AHS3004/2 (NSN 6115-99-525-5209) for the Victoria Class Submarine Fleet.

Justification for the Pre-Identified Supplier
Request for Quote (RFQ ) W8482-184040/A was posted on buyandsell.gc.ca from 2018/05/04 to 2018/06/20 for which Canada received one response to provide Alternating Current Generators. The sole bidder, BAE SYSTEMS (Canada) was awarded contract W8482-184040/001/D Mar P 5. The Original Equipment Manufacturer has recently identified that the material will no longer be produced and will become obsolete. The requirements quantity has increased from 6 to 12 to support a ‘lifetime’ of stock for the Victoria Class Submarine Fleet. Due to the change in requirements, this ACAN is being posted with the belief that only one person is capable of performing the contract as allowed for under the Government Contract Regulations exceptions.

Text reads as follows:
An entity of a Party may, in the circumstances and subject to the conditions set out in paragraph 2, use limited tendering procedures and thus derogate from Articles 1008 through 1015, provided that such limited tendering procedures are not used with a view to avoiding maximum possible competition or in a manner that would constitute a means of discrimination between suppliers of the other Parties or protection of domestic suppliers. for additional deliveries by the original supplier that are intended either as replacement parts or continuing services for existing supplies, services or installations, or as the extension of existing supplies, services or installations, where a change of supplier would compel the entity to procure equipment or services not meeting requirements of interchangeability with already existing equipment or services, including software to the extent that the initial procurement of the software was covered by this Chapter; (CAP Code 74).

The product must be delivered between 01 April 2019 – 30 April 2019.
Cost estimate of the proposed contract
The estimated value of the contract, including option(s), is $69,500 -$80,000.00 (GST/HST extra).

The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
