    Description

    Purpose of an Advance Contract Award Notice (ACAN)

    An Advance Contract Award Notice (ACAN) allows a department to post a notice, for no less than fifteen calendar days, indicating to the supplier community that it intends to award a contract to a pre-identified contractor. If no other supplier submits, during the fifteen calendar day posting period, a statement of capabilities that meets the requirements set out in the ACAN, the competitive requirements of the government’s contracting policy have been met. Following notification to suppliers not successful in demonstrating that their statement of capabilities meets the requirements set out in the ACAN, the contract may then be awarded using the Treasury Board’s electronic bidding authorities.

    If other potential suppliers submit statements of capabilities during the fifteen calendar day posting period, and meet the requirements set out in the ACAN, the department must proceed to a full tendering process on either the government’s electronic tendering service or through traditional means, in order to award the contract.

    1. Definition of Requirement

    The purpose of this project is to deliver an authentic indigenous tourism offer in Kejimkujik National Park and Historic Site, using the Mi’kmaw birch bark canoe to provide exceptional experiences to park visitors and to engage and support Mi’kmaw communities.

    The goal is to honor and showcase the traditional culture of the local Mi’kmaw people by offering an interpretation program demonstrating the building of traditional birch bark canoes during the peak visitor season.

    The Contractor will: prepare and gather canoe-building materials to build two birch bark canoes; construct two canoes in 2019 (over 15 weeks) at Kejimkujik National Park and Historic Site; provide paid workshops, public demonstrations and programming, participate in promotional and media opportunities to share the birch bark canoe story and liaise with apprentices and other interested visitors from Mi’kmaw communities.

    2. Security Requirement

    There is no security requirement associated with this contract.

    3. Governing Contracting Rules

    This procurement is subject to the Government Contracts Regulations (GCRs), the North American Free Trade Agreement and the Canadian Free Trade Agreement.

    4. Ownership of Intellectual Property

    The Parks Canada Agency has determined that any intellectual property arising from the performance of the work under the contract will vest with the Contractor. This includes the proprietary and intellectual rights to the finished canoe.

    5. Period of Proposed Contract

    The project will begin upon contract award and be completed by October 31, 2019, with a possibility of two one-year option periods.

    6. Reason for non-competitive award

    Section 6 (d) of the Government Contracts Regulations – only one person is capable of performing the contract

    Suppliers, who consider themselves fully qualified and available to provide the services described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
