    Description

    The Canadian Food Inspection Agency (CFIA) has a requirement for the provision of essential support services and an annual preventative maintenance for its autoclave equipment in the Greater Toronto Area (GTA) Laboratory. The purpose of this Advance Contract Award Notice (ACAN) is to signal the government's intention to award a contract for these services to Getinge, 90 Matheson Blvd West, Suite 300, Mississauga, ON, L5R 3R3, Canada. Before awarding a contract, however, the government would like to provide other suppliers with the opportunity to demonstrate that they are capable of satisfying the requirements set out in this Notice, by submitting a statement of capabilities during the 15 calendar day posting period.

    If other potential suppliers submit a statement of capabilities during the 15 calendar day posting period that meet the requirements set out in the ACAN, the government will proceed to a full tendering process on either the government's electronic tendering service or through traditional means, in order to award the contract.

    If no other supplier submits, on or before the closing date, a statement of capabilities meeting the requirements set out in the ACAN, a contract will be awarded to the pre-selected supplier.

    Background

    The CFIA GTA Laboratory is responsible for food safety testing including the testing of food for indicator organisms, pathogens, commercial sterility, container integrity, extraneous matter and safety parameters as well as test method development and validation. Autoclaves are critical to deliver the laboratory services as they are used multiple times per day for the preparation of sterile media, reagents, utensils and supplies as well as for the decontamination of waste. There are currently two (2) autoclave equipment that requires essential support services and an annual preventative maintenance.

    The proposed contract is for a period of eleven (11) months, from May 1, 2019 to March 31, 2020 with an irrevocable option on the part of Canada to extend the period by up to an additional four one-year periods. CFIA reserves the right to exercise options non-consecutively and is under no obligation to exercise any option. Optional services are included in the resulting contract for the provision of the same services, essential support services and an annual preventative maintenance, to the same OEM autoclave equipment in other CFIA Laboratories across Canada.

    The estimated value of the contract, including the option periods, is up to $101,488.40 (excluding HST). The optional services will be an additional value to the resulting contract.

    Minimum Essential Requirements

    Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:

    • Provide an annual preventative maintenance (PM), which includes a minimum of four (4) preventative maintenance inspections per year (preventative maintenance and minor repairs made during inspection visits. Also, the Contractor must provide service maintenance to meet and ensure proper functioning of two (2) laboratory autoclaves throughout the duration of the contract; 
    • Provide a trained field service representative that is certified and authorized to provide on-site service and preventative maintenance on Getinge autoclaves;
    • Provide original equipment manufacturer (OEM) certified replacement parts (new parts only) and consumables according to the defined maintenance procedures. Structural autoclave door issues and steam gaskets, excluded;
    • Provide loaner parts, reconditioned parts or previously used parts to keep the instruments operational until new OEM factory certified replacement parts are available and installed. Should the manufacturer not make the certified replacement parts anymore the laboratory would consider refurbished parts.
    • Provide unlimited emergency service calls, including repair, at no charge during regular business hours (Monday to Friday, 830am to 430pm), as requested.
    • Provide unlimited support for maintenance, operation, and troubleshooting of the instruments, over the phone, by email or in person during regular business hours (Monday to Friday, 830am to 430pm), as requested.
    • Must be able to provide support services and preventative maintenance to the same OEM autoclave equipment in other CFIA laboratories across Canada.

    Justification for the Pre-Selected Supplier

    Getinge is the only known supplier that can provide the services that meets the minimum essential requirements.

    The following exception to the Government Contracts Regulations is invoked for this procurement under Part 1 subsection 6(d) - "only one person is capable of performing the work".

    Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor.

    Submission of Statement of Capabilities

    Suppliers who consider themselves fully qualified and available to meet the specified requirements may submit a statement of capabilities, in writing, to the Contracting Authority identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.

    The closing date and time for accepting statements of capabilities is May 2, 2019 at 2pm Eastern Standard Time.
