    Description

    Advance Contract Award Notice (ACAN)

    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.

    Definition of the Requirement

    The Department of National Defence (DND) Canadian Forces Fire Marshall (CFFM) has a requirement for the supply of up to 110 bilingual Fire Prevention Week Kits (FPW Kits) to be distributed to requesting DND / Canadian Armed Forces (CAF) Fire Departments and / or HMC Ships across Canada. These FPW Kits must align with the National Fire Protection Association Fire Prevention Week theme.

    Minimum Essential Requirements

    Any interested supplier must demonstrate by way of a Statement of Capabilities that it can meet the following requirements:

    Fire Prevention Week Kits:
    The Fire Prevention Week Kit is a fire prevention educational tool that is designed yearly for Fire Prevention week to inform adult and children on home fire prevention. The FPW Kits are comprised of an array of fire prevention and educational material such as: fire prevention booklets, pamphlets, activity books and tools on helping a family escape their home in the event of a fire emergency situation. FPW Kits must align with the National Fire Protection Association Fire Prevention Week theme.

    Each FPW Kit will include:
    1 Fire Prevention Week (FPW) Banner
    100 FPW Magnets
    20 FPW Posters
    100 FPW Stickers
    100 FPW bags (bilingual)
    100 FPW Brochures
    100 FPW Kids Activity Books
    50 Sparky Growth Charts (bilingual)
    50 Sparky Punch Out & Colour Coin Banks (bilingual)
    25 Sparky Flying Discs (bilingual)

    100 Sparky Temporary Tattoos (bilingual)

    100 4 pk. Crayons (bilingual)
    100 Children’s Red Fire Hats (bilingual)
    50 Kitchen Sure Grip Jar Openers (bilingual)

    25 Silicone Basting Brushes (bilingual)

    Packaging and Distribution:

    Assemble and ship up to 110 (e.g. 25 French and 85 English) FPW Kits once each year by 30 September to various locations across Canada as per a specified distribution table that will be updated annually.

    Justification for the Pre-Identified Supplier

    Canadian Public Safety Operations Organization (CanOps) is the only known vendor that can satisfy the requirements for these FPW Kits.

    Government Contracts Regulations Exception

    The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) “only one person or firm is capable of performing the work”.

    The following exclusion and/or limited tendering reasons are invoked under the

    Canadian Free Trade Agreement (CFTA) – Article 513: Limiting Tendering 2.(ii)

    North American Free Trade Agreement (NAFTA) – Article 1016: Limited Tendering Procedures 2.(b)

    Comprehensive Economic and Trade Agreement (CETA) - The protection of patents, copyrights or other exclusive rights

    World Trade Organization – Agreement on Government Procurement (WTO-AGP) – Article XV: Limiting Tendering Procedure 1.(b)

    Period of proposed contract

    The estimated contract period is for three (3) years with two (2) one-year option periods.

    Cost of proposed contract

    The estimated value of the contract, including options is $293,000.00 (Applicable Taxes extra).

    Suppliers’ right to submit a Statement of Capabilities

    Suppliers who consider themselves fully qualified and available to meet the specified requirements may submit a statement of capabilities in writing to the Contracting Authority identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.

    Closing date

    The closing date and time for accepting Statements of Capabilities is 20 August 2019 at 2:00 p.m. EDT.
