    Description

    1. Advance Contract Award Notice (ACAN)
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.

    2. Definition of the requirement

    The Department of National Defence has a requirement for the supply of:

    Item 1, GSIN: 3655, NSN: 3655-01-626-3554, TRANSFER UNIT,LIQUID OXYGEN

    Part No.: 50C-0115-1, NCAGE: 19062

    Quantity: 2, Unit of Issue: EA

    *Each item must be tested to MIL-STD-810H (or latest revision).

    3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)
    Any interested supplier must demonstrate by way of a statement of capabilities, in the form of a letter from the Original Equipment Manufacturer (OEM), upon request, stating that the OEM will supply the items listed in part 2.

    4. Applicability of the trade agreement(s) to the procurement
    This procurement is subject to the following trade agreements:

    the World Trade Organization Agreement on Government Procurement (WTO-AGP), the North American Free Trade Agreement (NAFTA), the Canada-Chile Free Trade Agreement (CCFTA), the Canadian Free Trade Agreement (CFTA), the Canada-Peru Free Trade Agreement (CPFTA), the Canada-Columbia Free Trade Agreement (CColFTA), the Canada-Panama Free Trade Agreement (CPanFTA), the Canada-Honduras Free Trade Agreement (CHFTA), the Canada-Korea Free Trade Agreement (CKFTA), the Canada-European Union Comprehensive Economic and Trade Agreement (CETA) and the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP).

    5. Justification for the Pre-Identified Supplier

    The transfer unit, liquid oxygen sought by the Department of National Defence on this procurement (as outlined under part 2) is only manufactured by one supplier, Essex Industries. Essex Industries is the only manufacturer capable of performing the work.

    Government Contracts Regulations Exception:

    The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6 (d), only one person is capable of performing the work.

    6. Exclusions and/or Limited Tendering Reasons

    The following exclusions and limited tendering reasons are invoked under the:

    North American Free Trade Agreement (NAFTA) - Article 1016.2(b)

    7. Ownership of Intellectual Property

    • Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor.

    8. Period of the proposed contract or delivery date

    The estimated value of the contract is $275,200.00 CAD (taxes included), 90 days delivery.

    10. Suppliers' right to submit a statement of capabilities
    Suppliers who consider themselves fully qualified and available to provide the goods described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
