    Description

    DEFINITION OF REQUIREMENTS:

    The Fredericton Research and Development Centre in Fredericton, NB, requires a service and maintenance plan for a Illumina NextSeq500 instrument. The services provided by Illumina are:

    1.  Illumina Product Care NextSEQ 500 System Health Check (one time) which includes all labour, travel and replacement of all parts in the Preventative Maintenance Kit; Component Inspection; Subsystem Maintenance; and System Requalification.
    2. Illumina Product Care NextSEQ 500 Preventative Maintenance (annual) which includes all labour, travel and replacement of all parts in the Preventative Maintenance Kit; Component Inspection; Subsystem Maintenance; and System Requalification.
    3. NextSeq500 Silver Support Plan which includes full coverage for parts, labour and travel; Reagent replacement upon Hardware failure; Remote Technical Support; Software and Hardware updates; and remote monitoring

    CRITERIA FOR ASSESSMENT OF THE STATEMENT OF CAPABILITIES:

    Any interested supplier must demonstrate by way of a statement of capabilities that it meets the requirements and must fully demonstrate they are authorized by Illumina Inc to provide service and maintenance on a Illumina NextSeq500 instrument.

    CONTRACT PERIOD:

    The contract will in place until March 31, 2020 with the following option periods:

    • Option Period #1 - April 1, 2020 to March 31, 2021
    • Option Period #2 - April 1, 2021 to March 31, 2022 

    ESTIMATED VALUE: $ 122,458.01 including HST (value includes option periods)

    SOLE SOURCE JUSTIFICATION:

    Illumina Inc. is the manufacturer of the DNA sequencer NextSeq500. Illumina Inc. holds patents for their technology and there are no other providers for equipment service and support plan for instruments manufactured by the company. Illumina does not licence their technology to any third party to service their equipment. Illumina Inc. is also the only manufacturer of the consumables and replacement parts for their equipment.

    Government Contracts Regulations Exception and Limited Tendering Reason:

    Section 6 (d) has been invoked for this procurement as only one supplier (person/firm) is capable of performing the contract.

    Where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists.

    ACAN NOTICE:

    You are hereby notified that the government intends to negotiate with one firm only as identified above. Should you have any questions concerning this requirement, contact the Contracting Authority.

    An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a "Statement of Capabilities" that meets the requirements set out in the ACAN, the Contracting Authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the Contracting Authority will proceed to a full tendering process with a technical and financial evaluation methodology of the bids proposed by the potential bidders.

    Inquiries on Submission of Statement of Capabilities:

    Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing, either via letter, facsimile or Email to the contact person identified in this Notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.

    The Solicitation Number, Name of Contracting Authority and closing date of the ACAN must appear within your Statement of Capabilities.
