    Advance Contract Award Notice (ACAN)
    An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, during the fifteen calendar day posting period, a statement of capabilities that meet the requirements set out in the ACAN, the competitive requirements of the government's contracting policy have been met. Following notification to suppliers not successful in demonstrating that their statement of capabilities meets the requirements set out in the ACAN, the contract may then be awarded using the Treasury Board's electronic bidding authorities.

    If other potential suppliers submit statements of capabilities during the fifteen calendar day posting period, and meet the requirements set out in the ACAN, the department or agency must proceed to a full tendering process on either the government's electronic tendering service or through traditional means, in order to award the contract.

    TITLE:

    Sitewise Pro/ PCensus database licenses by Federal Economic Development Agency for Southern Ontario

    BACKGROUND:

    Federal Economic Development Agency for Southern Ontario (FedDev) has a requirement to procure 40 licenses to a market research database, for use by Regional Development Agency (RDA) Canada Business offices (Western Economic Diversification, Atlantic Canada Opportunities Agency, Canada Economic Development for Quebec Regions, and FedDev) through a shared, cost-savings procurement process.

    REQUIREMENTS/ RESULTS:

    The Federal Economic Development Agency for Southern Ontario (FedDev Ontario) has a requirement to renew the annual subscription for 40 (forty) licenses to demographic software, capable of providing market research data in order to conduct secondary market research analysis for our small business clients.

    SCOPE OF WORK AND DELIVERABLES:

    1. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements). Any interested supplier must demonstrate by way of a statement of capabilities that its product meets the following requirements:

    It is necessary that the Regional Development Agencies (RDA) utilize the same database to ensure consistency in the type of data and quality of data available to business clients across the country and to be able to compare data across regions. Renewing subscription to Sitewise Pro/PCensus is required, for the RDAs to be able to compare data and reporting trends year-over-year. The software has the capacity to:

    • Draw current demographic data from authoritative, reputable sources, such Pitney Bowes and Statistics Canada.
    • Retrieve demographic profiles for standard census and postal areas.
    • Integrate demographic data and business locations in a customizable Word document report with maps, charts and textual descriptions.
    • Display potential customer locations on a map to define a client’s market area.
    • Produce reports around proposed business locations using circles, polygons, or driving distances. 
    • Produce report packages that are customizable to the needs of the RDA business offices and include tables, charts, metrics, descriptive text and maps with thematics or aerial imagery. Utilize demographic data that is updated on a daily basis.
    • Draw information about business trends and local competitors.

      This procurement is subject to the following trade agreement(s): 
      • Canadian Free Trade Agreement (CFTA); and
      • North American Free Trade Agreement (NAFTA)
    2. Justification for the Pre-Identified Supplier

      This is an annual renewal of a subscription (that was formerly procured for the Canada Business offices centrally through Innovation, Science and Economic Development Canada - ISED) to access a market research database that provides comprehensive and reliable Canadian demographics data (i.e. population, household and income trends, etc.) at various levels of geographic and administrative detail.

      Based on our research, it is not feasible to compete this requirement, as this is the only software with a delivery method of the information required by RDA small business clients when looking for ways to start a new business or grow their current business. The database is subject specific.

      The database was developed in-house and the vendor owns the intellectual property.

      The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection (6(d) - "only one person is capable of performing the work").

    1. Exclusions and/or Limited Tendering Reasons
      The following exclusion(s) and/or limited tendering reasons are invoked under the:
      • Canadian Free Trade Agreement (CFTA) – Article 513.1 (b) (ii) the protection of patents, copyrights, or other exclusive rights;
      • North American Free Trade Agreement (NAFTA) – Article 1016.2 (b) where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists; and (d) for additional deliveries by the original supplier that are intended either as replacement parts or continuing services for existing supplies, services or installations, or as the extension of existing supplies, services or installations, where a change of supplier would compel the entity to procure equipment or services not meeting requirements of interchangeability with already existing equipment or services, including software to the extent that the initial procurement of the software was covered by this Chapter;
