    Advanced Contract Award Notice (ACAN) 22-58010

    1. Advance Contract Award Notice (ACAN)

    An ACAN is a public notice indicating to the supplier community that a 

    Department or agency intends to award a contract for goods, services to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. 
    If no supplier submits a statement of capabilities that meets the
    requirements set out in the ACAN, on or before the closing date stated in
    the ACAN, the contracting officer may then proceed with the award to the
    pre-identified supplier. 

    2. Definition of the requirement

    The National Research Council located in Ottawa has a Requirement for Annual Maintenance Service and Replacement Parts contract to support our RAITH EBP5200 E-beam direct write system, Serial Number 1-00A-203.

    This Contract must include the Unlimited Service Visits and Spare Parts. It also must include an annual Preventive Maintenance Visit, Consumable Parts Coverage, Software Update Coverage, and Advanced Options Coverage.

    Additional Services may be purchased with the Flex Contract configuration.

    3. Criteria for assessment of the Statement of Capabilities
    (Minimum Essential Requirements)

    Knowledge and training on the operation and maintenance of the RAITH EBP5200 E-beam direct write system, the ability to support the original system software and the repair of all ‘bugs’. The ability to provide unlimited access to you support centre, and to provide technical support via remote access when required.

    4. Justification for the Pre-Identified Supplier

    This proposed contract is linked to previous maintenance agreements via an extended warranty with Raith America, Inc. It is NRC's position that it would not be feasible to tender this Maintenance contract because the equipment to be repaired or serviced under this contract is manufactured by Raith America, Inc. This is critical for guaranteed availability of parts for warranty work, and for timely response to equipment breakdowns and process issues related to the performance of this highly specializes Photonic manufacturing equipment. Where service is provided by experienced OEM trained process and maintenance staff. Raith America Inc. is the only company qualified to provide maintenance service this equipment.

     5. Exclusions and/or limited-tendering reasons:

    The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work".

    6. This procurement is subject to the following trade agreement(s):

    • Canadian Free Trade Agreement (CFTA)

    • World Trade Organization - Agreement on Government Procurement (WTO-AGP)WTO-GAP

    7. Period of the proposed contract or delivery date

    The proposed contract period will be from April 9th 2022 to April 8 2023.

    With the option to renew for two additional one-year periods. 

    8. Cost estimate of the proposed contract

    The estimated value of the contract, including option(s), is estimated $175,487.00 USD per year

    Suppliers who consider themselves fully qualified and available to provide the goods, services described in the ACAN may

    identified in this notice on or before the closing date of this notice. The
    statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.

    The closing date and time for accepting statements of capabilities is: May 30th, 2022, 2pm (EDT)
