    Description

    1.0 ADVANCE CONTRACT AWARD NOTICE (ACAN) # INFC-2022/23-PS4415

    1. An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities.

    2.If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.

    2.0 DEFINITION OF THE REQUIREMENT

    1. The Department of Infrastructure Canada (INFC) requires ongoing access to multimodal on-demand transportation data and indicators across Canada including urban and rural communities. This data is expected to inform departmental decision making across different projects and programs. The data addresses the following, but not limited to:

    a. Multi-Mode data such as all vehicles, trucks, public transit, rail, bikers, and pedestrian;

    b. Access to unlimited number of departmental users to an online platform that provides interactive access to relevant mobility metrics such as, mode volume counts, vehicle kilometers travelled, length of trips, speed of trips, vehicle hours of delay, congestion factors and demographics by trip volume, etc.;

    c. Ongoing case studies;

    d. Assistance with large scale analyses;

    e. Ability to access via a web-platform;

    f. Ability to draw customizable zones of analysis;

    g. A minimum of 250 zones available with the initial contract with the capability to add zones as required; and

    h. Ability to request professional services to address specific requirements in support of Projects.

    3.0 CRITERIA FOR ASSESSMENT OF THE STATEMENT OF CAPABILITIES (Minimum Essential Requirements)

    1. Experience providing data with reliable and timely on-demand data and metrics;

    2. Relevant methodologies comparable in the industry across all road and rail transportation modes;

    3. More than 5 years of experience with mobility metrics;

    4. Online/cloud based-platform;

    5. Unlimited user access;

    6. Downloadable files in different formats including CSV, Excel and shapefiles;

    7. Ongoing support and excellence client service;

    8. Ability to provide professional services to address tailored data;

    9. Proven record of evolving and improving metrics and methods over time Ability to access via a web-platform; and

    10. Ability to draw customizable zones of analysis.

    4.0 APPLICABILITY OF THE TRADE AGREEMENTS TO THE PROCUREMENT

    This procurement is subject to the following trade agreements:

      5.0 SET-ASIDE UNDER THE PROCUREMENT STRATEGY FOR ABORIGINAL BUSINESS

      This procurement is not subject to any set-asides for Indigenous/Aboriginal suppliers.

      6.0 COMPREHENSIVE LAND CLAIMS AGREEMENT(S)

      This procurement is not subject to any Comprehensive Land Claims Agreements.

      7.0 JUSTIFICATION FOR THE PRE-IDENTIFIED SUPPLIER

      1. StreetLight is the only company that offers on-demand data for multiple modes including vehicles, medium, and/or heavy-duty trucks, bicycles, pedestrians, bus and rail all in one platform. StreetLight uses unique proprietary algorithms and machine learning to analyze different modes of travel.

      2. INFC has tested the platform and analyzed the data usage and value added and concluded that Streetlight offers data that is applicable to more than 80% of INFC project portfolio. StreetLight evolves and adapts its data and metrics to its clients and industry needs.

      8.0 GOVERNMENT CONTRACTS REGULATIONS EXCEPTION:

      The following exception to the Government Contracts Regulations (https://laws.justice.gc.ca/eng/regulations/SOR-87-402/FullText.html) is invoked for the procurement under subsection 6(d) – “only one firm is capable of performing the contract”.)

      9.0 EXCLUSIONS AND/OR LIMITED TENDERING REASONS

      The following exclusions and/or limited tendering reasons are invoked under the:

    • Canadian Free Trade Agreement (CFTA) – Article 513. b. iii: Due to an absence of competition for technical reasons
    • Canada-Chile Free Trade Agreement (CCFTA) – Article Kbis-09.1. c: For additional deliveries by the original supplier that are intended either as replacement parts, extensions, or continuing services for existing equipment, software, services or installations, where a change of supplier would compel the entity to procure goods or services not meeting requirements of interchangeability with existing equipment, software, services, or installations;
    • Canada-Columbia Free Trade Agreement (CColFTA) – Article 1409.1. b. iii: Due to an absence of competition for technical reasons;
    • Canada-Honduras Free Trade Agreement (CHFTA) – Article 17.11.2.b. iii: There is an absence of competition for technical reasons;
    • Canada-Korea Free Trade Agreement (CKFTA) – Article 22.1.3.b: To ensure compliance with laws and regulations that are not inconsistent with this Agreement;
    • Canada-Panama Free Trade Agreement (CPanFTA) – Article 16.10.1.b.iii: Of the absence of competition for technical reasons;
    • Canada-Peru Free Trade Agreement (CPFTA) – Article 1409.1.b.iii: Due to an absence of competition for technical reasons;
    • Canada-Ukraine Free Trade Agreement (CUFTA) – Article 10.13.1. b. iii: Due to an absence of competition for technical reasons;
    • Comprehensive Economic and Trade Agreement (CETA) – Article 19.12.1.b. iii: Due to an absence of competition for technical reasons;
    • Canada-United Kingdom Trade Continuity Agreement (C-UKTCA) – CETA Article 19.12.1. b. iii (same as CETA): Due to an absence of competition for technical reasons;
    • Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) – Article 15.10.2. b. iii: Due to an absence of competition for technical reasons; and
    • World Trade Organization Agreement on Government Procurement (WTO-AGP) – Article XIII.1. b. iii: Due to an absence of competition for technical reasons;

      10.0 OWNERSHIP OF INTELLECTUAL PROPERTY

      1. The supplier owns the intellectual property of its online platform and the algorithm related to the transportation metrics indicated above.

      2. INFC is expected not to sell or distribute the supplier intellectual property. However, INFC could use the data without any restriction as long as analyses is respectful of individual privacy for individuals within StreetLight’s data sets.

      11.0 PERIOD OF THE PROPOSED CONTRACT

      The Contract is to start asap and is for a minimum of three years with consideration for potential options for additional years.

      INFC will have access to the platform immediately after the signature of the Contract.

      12.0 COST ESTIMATE OF THE PROPOSED CONTRACT

      INFC is expecting a multiyear (3 years minimum) subscription including 250 zones (baseline) with the capacity to add zones as required. Cost estimate is $250,000 (GST/HST extra)

      14.0 SUPPLIERS’ RIGHT TO SUBMIT A STATEMENT OF CAPABILITIES

      Suppliers who consider themselves fully qualified and available to provide the services/goods described herein may submit a Statement of Capabilities by e-mail, to the contact person identified in section 16 of this Notice on or before the closing date and time of this Notice (see section 15). The Statement of Capabilities must clearly demonstrate how the supplier meets the advertised requirements.

      15.0 CLOSING DATE AND TIME

      The closing date for a submission of a Statement of Capabilities is March 15, 2023 at 14:00 PM (24:00) Eastern Daylight Savings (EDT).
