Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement To enter into Contract with Magellan Aerospace, Mississauga, Ontario, for the Repair and Overhaul of the J85CAN40 Engine on behalf of the Department of National Defence. This contract will cover the repair, overhaul, manufacturing, periodic inspection, modification and spares reduction of the J85-CAN-40 engine (military version) and related components manufactured by Magellan Aerospace under a license agreement with General Electric Canada. The nature of work also includes company provision of Technical Investigation and Engineering Support (TIES) services as required by the client as well as provision of a Technical Services Representative at National Defence Headquarters (NDHQ) to assist in troubleshooting the J85-CAN-40 engine at any of the bases across Canada. The company must also provide a publication management service, offer program management services to support Contractor work, as well as ensure technical airworthiness for all aspects of repair, overhaul, engineering and periodic inspection of J85-CAN-40 engine and associated components in accordance with client technical publications. 3. Applicability of the trade agreement(s) to the procurement As this is a service contract on the behalf of the Department of National Defence under Federal Stock Class 16, it is exempt from the North American Free Trade Agreement (NAFTA) in accordance with NAFTA Chapter 10, Annex 1001.1b-1 Section A para 2 and Annex 1001.1b-2, Section B General Note 1; and from the World Trade Organization Agreement on Government Procurement (WTO-AGP) in accordance with WTO-AGP Annex 1 and 4, note 4. The Agreement on Internal Trade applies and the limited tendering strategy as per Article 506.12(a) applies (to ensure compatibility with existing products, to recognize exclusive rights, such as exclusive licenses, copyright and patent rights, or to maintain specialized products that must be maintained by the manufacturer or its representative). 4. Justification for the Pre-Identified Supplier You are hereby notified that it is the intention of Public Works and Government Services Canada (PWGSC) to negotiate a sole source contract for this requirement with Magellan Aerospace, Mississauga, Ontario, Canada as they are the only known company capable of performing the work due to license agreements. 5. Period of the proposed contract or delivery date Contract period: 1 October 2013 to 31 March 2016 with a one year option period to 31 March 2017. 6. Cost estimate of the proposed contract The estimated cost of the proposed contract including the option period is $18,080,000.00 HSTI. 7. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 9. Closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is September 13, 2013, at 2:00 p.m. EST. 10.
