    1.		Purpose of an Advance Contract Notice (ACAN)
    An Advance Contract Award Notice (ACAN) allows department and
    agencies to post a notice, for no less than fifteen (15)
    calendar days, indicating to the supplier community that it
    intends to award a goods, service or construction contract to a
    pre-identified supplier.  If no other supplier submits, on or
    before the closing date, a Statement of Capabilities that meets
    the requirements set out in the ACAN, the contracting authority
    may then proceed with the award.  However, should a Statement of
    Capabilities be found to meet the requirements set out in the
    ACAN, then the contracting officer will proceed to a full
    tendering process.
    
    2.		Definition of requirement
    Background:
    The Prairie and Northern Air Quality Seience Unit has a
    requirement for the purchase of a Continuous Particulate Matter
    Instrument (Environmental Dust Monitor) at the Environment
    Canada building in Edmonton, Alberta, Canada.
    
    Environment Canada has an existing mobile monitoring trailer. 
    The Continuous Particulate Matter Instrument (Environmental Dust
    Monitor) will be placed in this trailer.
    
    This equipment must be delivered no later than 31 March 2013.
    
    Specifications for a Continuous Particulate Matter Instrument
    (Environmental Dust Monitor)
    Equipment must meet or exceed the following specifications:
    Must be able to simultaneously measure particulate matter mass
    in PM10, PM2.5 and PM1 size fractions;
    Must measure continuously at 1 minute sampling time;
    Must be rack mountable on a 19 inch rack;
    Must have US EPA Federal Equivalency Method approval for at
    least one of PM10 or PM2.5;
    Must be able to withstand some movement in a mobile trailer
    (i.e., no moving parts; no fragile parts);
    Must be able to operate in cold climates <-20 degrees C;
    Must be able to measure size distributions from 0.25 µm - 32 µm;
    Must come with sample pipe with sensors for temperature and
    humidity, and a 1.5m sampling pipe extension;
    Must have RS232 or Ethernet connection;
    Must include instrument specific software and license;
    Must include a date storage card (>1 MB);
    Must include all supporting and/or peripheral equipment, such as
    any required installation hardware, cables, connectors and
    software license;
    Must be delivered and received on or before March 31, 2013;
    Must come with Operator Manual and Maintenance Manual.

    3.		Justification for Pre-Selected Supplier 
    This supplier is the only known source of supply of required
    goods meeting the above mentioned minimum essential requirements.
    	
    4.    	Trade Agreements

    Article 1016, Section 2, (b) of the North American Free Trade
    Agreement (NAFTA) 
    Limited Tendering Procedures - where, for works of art, or for
    reasons connected with the protection of patents, copyrights or
    other exclusive rights, or proprietary information or where
    there is an absence of competition for technical reasons, the
    goods or services can be supplied only by a particular supplier
    and no reasonable alternative or substitute exists; 
    
    Article 506, Section 12(b)of the Agreement on Internal Trade
    (AIT)
    Where only one supplier is able to meet the requirements of a
    procurement, an entity may use procurement procedures that are
    different from those described in paragraphs 1 through 10 in the
    following circumstances: b.where there is an absence of
    competition for technical reasons and the goods or services can
    be supplied only by a particular supplier and no alternative or
    substitute exists;
    
    5.	Government Contracts Regulations Exception
    This contract is subject to subsection 6(d) of the Government
    Contracts Regulations, in that only one person or company is
    capable of performing the contract.

    8.	Submission of Statement of Capabilities by Suppliers
    Suppliers who consider themselves fully qualified and available
    to provide the services/goods described herein, may submit a
    statement of capabilities in writing to the contact person
    identified in the Notice on or before the closing date of this
    Notice.  The statement of capabilities must clearly demonstrate
    how the supplier meets the advertised requirements.
    
    The PWGSC file number, the contracting officer's name and the
    closing date for the ACAN must appear on the outside of the
    envelope in block letters or, in the case of a facsimile
    transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any
    procurement. Documents may be submitted in either official
    language of Canada.
    
    9.	The Closing Date for a Submission of a Statement of
    Capabilities
