Purpose of an Advance Contract Notice (ACAN) An Advance Contract Award Notice (ACAN) allows department and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a goods, service or construction contract to a pre-identified supplier. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting officer will proceed to a full tendering process. 2. Definition of requirements and sole source justification The Department of National Defence (DND), CFB Edmonton has a requirement for the supply of a heavy duty treadmill and running analysis system to be delivered to their location in Edmonton Alberta. Delivery is requested to be completed on or before March 31, 2014, but later delivery is acceptable. DND has identified that the Woodway Pro XL Treadmill with OPTOGAIT video analysis system is the only known product to meet their full requirement. Canadian Forces (CF) personnel have unique training requirements and need to be able to attain high speeds and simulate hilly mountainous terrain, DND requires a treadmill that can attain 16.5mph and an incline range of 25% (-3% to 22%). The treadmill must be durable to the normal wear and tear of both walking and running with combats boots, since it is the requirements for some Trade-Specific Physical Fitness Evaluation. Must be rated for 150,000 miles of use and has a 5 year wear warranty (running surface, drive and motor), 3 year warranty for all components and 1 year labor. The treadmill must be capable of a weight capacity of 400lbs while running or 800lbs while walking @ 4 mph, which allows training and completing physical fitness evaluation with external load. Additional features such as handrails pointing straight down, allows an easier access, either from the side or the back for individuals will less mobility and at the same time a better supervision of the user when required. A running surface of 27" x 88" or greater is required. The running analysis system is required to be portable and measure the following: i. Step and stride length; ii. Stance and swing phase; iii. Single and double support; iv. Contact and fight time; v. Reaction time; vi. Elevation of center of gravity; vii. Specific power in Watts or Kilograms; viii. Frequency Energy expended in Joules; DND will be phasing out the current treadmill fleet as they become unserviceable and will be planning to procure more similar treadmills in the future. 3. Trade Agreements Article 1016, Section 2, (b) of the North American Free Trade Agreement (NAFTA) "...where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists;" Article 506, Section 12 (b) of the Agreement on Internal Trade (AIT) "...where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists;" 4. Government Contracts Regulations Exception This contract is subject to subsection 6 (d) of the Government Contracts Regulations, in that only one person or company is capable of performing the contract. 5. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
