Purpose of an Advance Contract Notice (ACAN) An Advance Contract Award Notice (ACAN) allows department and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a goods, service or construction contract to a pre-identified supplier. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting officer will proceed to a full tendering process. 2. Definition of requirements and sole source justification NRCan, Devon, Alberta has a requirement for the supply and delivery of a Laboratory Density Meter DMA 4500 M and an XSample 452 H Heated Sample Changer. The Density Meter and the Heated Sample Changer must be able to attach to each other. The Density Meter will be used for measuring density samples at a specific temperature. The Heated Sample Changer will be used for loading samples into the Density Meter to produce data, the Heated Sample Changer will also allow NRCan to operate the system unattended. The Density Meter must have a mandatory camera, this would allow the operator to see the entire tube to entire the sample is free of air bubbles and that the cleaning procedure was effective. The camera must be able to image the entire cell and allow the user to check for quality of the unique and varied sample the lab deals with. 2.1 Minimum Essential Requirements Any interested supplier must demonstrate by way of a statement of capabilities that its product meets the following specifications: The Density Meter must: Be able to handle bitumen samples with the Heated Sample Changer (be able to attach to each other), and be calibrated over the whole temperature range with one point. Have the ability to measure density at 15.6C (standard temp) of samples that do not flow below 60C and must automatically clean the cell afterwards. Must have a camera that allows the operator to see the entire tube to ensure the sample is free of air bubbles and that the cleaning procedure was effective. The camera must be able to image the entire cell and allow the user to check for quality of the unique and varied sample the lab deals with. 3. Trade Agreements Article 1016, Section 2, (b) of the North American Free Trade Agreement (NAFTA) "...where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists;" Article 506, Section 12 (b) of the Agreement on Internal Trade (AIT) "...where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists;" 4. Government Contracts Regulations Exception This contract is subject to subsection 6 (d) of the Government Contracts Regulations, in that only one person or company is capable of performing the contract. 5. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
