    1. Advance Contract Award Notice (ACAN)
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 
    
    2. Definition of the requirement
    The Public Health Agency Canada (PHAC) has a requirement for a Liquid Scintillation Counter (LSC) to replace the 
    one that requires expensive replacement parts in order to continue with lab work requiring isotopes which has been ongoing since 2005.  The instrument used for radioactive monitoring in the Viral Exanthemata and Sexually Transmitted Diseases section is no longer manufactured and servicing for the existing unit will eventually come  to an end. Purchasing the  Hidex 300SL from Gamble would allow for  lab activities requiring isotopes to continue without interruption and with servicing and technical support. Justification for the Pre-Identified Supplier Gamble Technologies Limited able to distribute the Hidex 300 SL, Liquid Scintillation Counter and meets all the performance specifications for the requirement.
    
    3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)
    Any interested supplier must demonstrate by way of a statement of capabilities that its equipment meets the following requirements:
    (1.) The LSC must be no larger then a width of 60.0cm, a height of 69.0cm, a depth of 65.0cm. A LSC larger then this would result in the need for renovations to the radioactive permit area.
    (2.) The LSC must have a weight of less than 175 kg to allow for placement on a regular lab bench.
    (3.) The LSC must have the following features:
    • absolute counting method using triple-to-double coincidence ratio (TDCR)
    • The LSC must have universal method for a range of isotopes. Must work for water-based or organic samples
    • The LSC must have multi-Channel analysis.
    • The LSC must have detection of beta-emitters on LSC mode up to 2000 keV, and alpha-emitters up to 10,000 keV.
    • The LSC must have detection of 5 ml, 7 ml and 20 ml vials. Vials require cap with flat top to enable pneumatic gripping. Vial compatibility must be confirmed with Hidex.
    • Vials are placed in barcoded racks with 6 x 20 ml vials (max 35 racks) and 10 x 7 ml or 10 x 5 ml vials (max 52 racks). Racks with different measurement templates and sizes can be mixed.
    • The LSC must have preset protocols: H-3 (unquenched, high water load and low water load), C-14, S-35, P-33, P-32, Fe-55, I-125, Ni-63, Sr-/Y-90 and Free. Other nuclides and Cerenkov counting can be easily defined.
    • The LSC must have Up to 4 energy regions (ROI) can be defined in same measurement.
    • The LSC must have Counting modes: Beta (all coincidences), Beta triple (luminescence free triple coincidences), and Alpha counting (a/b-separation, option),
    • The LSC must have Beta and alpha (option) spectrum analysis using Report Render analysis program.
    • The LSC must have Quench correction by TDCR method, TDCR-quench curve method, and External Eu-152 standard method with quench curve (option).
    • The LSC must have Software: MikroWin 600 SL Full Data reduction/instrument control software, compliant with 21CFR Part 11 and compatible with Windows 7 or higher.
    • The LSC must have  Connections: USB
    • The LSC must have Dimensions: Width 121 cm/ Depth 65 cm, Height 71 cm. Weight  < 200 kg
    • The LSC must have Counting efficiency typical > 70 % for H-3 and typical > 96 % for C-14 with unquenched samples.
    • The LSC must have Counting efficiency > 35 % for H-3, with 8 mL aq + 12 ml AquaLight.
    • The LSC must have Typical background 12 CPM, with 8 mL aq + 12 ml AquaLight, 25 % window.
    • The LSC must have Count Rate up to 3.000.000 CPM, with MCA.
    • The LSC must have *Performance data measured at Hidex factory in Turku, Finland. Background may vary locally depending on natural environmental radiation.
    (4.) The LSC must have the following Equipment 
    • 425-201 Automatic scintillation counter
    • 410-001 Owner’s Handbook
    • 431-307 Tray for 96 x 7mL vials
    • 431-320 Tray for 40 x 20mL vials
    • 840-097 ID code plates for Racks, 40pcs
    • 425-9900 Power supply 100-240V/24V
    • 529-011 USB interface cable
    • 450-002 Hidex 300 SL service software
    • 450-010 Report Render spectrum analysis software
    • Parameter Template Library and QA Report
    (5.) The LSC must have the following computer interface : 
    • Tower PC with LCD Monitor
    • Must be Windows 7 or later
    • Minimum of RAM 4GB, .NET4.5
    • Printer
    (6.) Must include installation and training, conducted by qualified Hidex Technicians
    (7.) Warranty must be standard one year, including all parts, labor, and travel. 
    
    4. Applicability of the trade agreement(s) to the procurement

    5. Justification for the Pre-Identified Supplier
    Gamble Technologies Limited able to distribute the Hidex 300 SL, Liquid Scintillation Counter and meets all the performance specifications for the requirement.
    6. Government Contracts Regulations Exception(s)
    The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - only one person is capable of performing the contract.
    
    7. Exclusions and/or Limited Tendering Reasons
    The following exclusion(s) and/or limited tendering reasons are invoked under the:
    North American Free Trade Agreement (NAFTA) - Article 1016 - 2(b) where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists.
    Agreement of Internal Trade (AIT) - Article 506 - 12(a) where only one supplier is able to meet the requirements of a procurement, an entity may use procurement procedures that are different from those described in paragraphs 1 through 10 in the following circumstances: to ensure compatibility with existing products, to recognize exclusive rights, such as exclusive licences, copyright and patent rights, or to maintain specialized products that must be maintained by the manufacturer or its representative;
