Purpose of an Advance Contract Notice (ACAN) An Advance Contract Award Notice (ACAN) allows department and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a goods, service or construction contract to a pre-identified supplier. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting officer will proceed to a full tendering process. 2. Definition of requirements and sole source justification The Department ofAgriculture and Agri-Food Canad requires one (1) Veris Technologies Optic Mapper to augment the existing collection of geo-referenced Agricultural Site Characterization equipment which are specifically designed to collect specific data on soil properties at a field scale. The Optic Mapper system will be used to, in partnership with existing AAFC projects, to study soil organic content, to calibrate with existing laboratory assessment methodology and to develop a standardized filed data collectionn (interpretation) methodology. Specifications for Optic Mapper The following specifications of the Veris Technologies Optic Mapper are critical functionalities required by Agriculture and Agri-Food Canada, Manitoba Region: - on-the-go measurement of soil conductivity (at two spacings, 1 and 3 feet) and dual optic wavelengths (visible and near infrared) - adjustable depth of optic window between 1 and 3 inches - NMEA 4X hermetically sealed enclosure with military-grade water proof connections - Operating Range -20C to 70C - Data recording compatibility with Trimble GPS equipment and with PC laptop - Pull behind 4WD pickup truck with, electro-hydraulic transition between field and highway 3. Trade Agreements Article 1016, Section 2, (b) of the North American Free Trade Agreement (NAFTA) "...where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists;" Article 506, Section 12 (b) of the Agreement on Internal Trade (AIT) "...where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists;" 4. Government Contracts Regulations Exception This contract is subject to subsection 6 (d) of the Government Contracts Regulations, in that only one person or company is capable of performing the contract. 5. Submission of Statement of Capabilities by Suppliers Suppliers who consider themselves fully qualified and available to provide the goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. Proof of unit testing or deployment on a shorebird species, specifically sandpipers or plovers will be required in the statement of capabilities. Acceptable proof will include published studies or through references (name/contact information must be supplied). The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
