    1. Advance Contract Award Notice
    
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
    
    2. Definition of the Requirement
    
    The Department ofNational Defence (DND) requires the supply, delivery and offloading of one (1) mobile supply system, to establish a mobile supply system compatible with all Royal Canadian Air Force (RCAF) and North Atlantic Treaty Organization (NATO) transport aircraftfloors, in support of Department of National Defence (DND) deployed operations.
    
     The Contractor must deliver the following:
    
    a. Five (5) ISU 90 GEN Containers
    
    b. Two (2) ISU 90 EO Containers
    
    c. Four (4) ISU 70 KC Containers
    
    d. One (1) ISU 90 GEN with kit container
    
    e. Thirty (30) trays, eight inch (8”) partitioned
    
    f. Twenty four (24) trays, five inch (5”) partitioned
    
    g. Twelve (12) Corner Casters kits
    
    h. Item #1 Seventy (70) Shelves
    
    i. Item #2 Twenty (20) shelves
    
    The containers must not require pallets in order to be compatible and fit directly into RCAF/NATO transport aircraft floors.  This will restrict shifting of containers and components for a safer flight shipment environment
    
    3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)
    
    ISU 90 GEN Containers
    
    Requirement:
    
    -Must have an external size of 108"W X 88"L X 91.35"H  
    -Must be a 4-DOOR made of a Lightweight, Aluminum, 1-Aircraft Pallet Position, Air-Mobile -Container for Shipping and Storage of Equipment, Spare Parts, and High Value Cargo.  
    
    ISU 90 EO Containers
    
    Requirement:
    
    -Must have an exterior size of 88"W X 108"L X 91.35"H
    -Must be 4-DOOR and is an end-opener with two doors on each 88" side. It isa Lightweight, Aluminum, 1-Aircraft Pallet Position Air-Mobile Container for Shipping and Storage of Equipment, Spare Parts, and High Value Cargo.
    
    ISU 70 KC Containers
    
    Requirement:
    
    -Must have an exterior size of 108"W X 88"L X 69"H
    -Must be 4-DOOR and is designed with one slanted side for ease of loading onto KC aircraft. It is a Lightweight, Aluminum, 1-Pallet Position Air-Mobile Container for Shipping and Storage of Equipment, Spare Parts, and High Value Cargo; and
    
    ISU 90 GEN Container with Kit
    
    Requirement:
    
    -Must have an external size of 108"W X 88"L X 91.35"H
    -Must be a 4-DOOR made of a Lightweight, Aluminum, 1-Aircraft Pallet Position, Air-Mobile Container for Shipping and Storage of Equipment, Spare Parts, and High Value Cargo
    -Must have Two 8-Drawer lock in place cabinets installed on same side of ISU 90 GEN Container; and 
    -Cabinets must come with Installation Kits if not installed by company.
      
    Trays eight inch partitioned
    
    Requirement:
    
    -Must have an external size of 40.38”L X 13.75”W X 8”D
    -Velcro closure strap to secure lid, Lightweight and durable
    -Eight inch Partitions removable
    -Full sliding lid for easy access to stored parts
    
    Trays five inch partitioned:
    
    Requirement
    
    -Must have an external size of 40.38”L X 13.75”W X 5”D; 
    -Velcro closure strap to secure lid, Lightweight and durable
    -Five inch Partitions removable; and 
    -Fullsliding lid for easy access to stored parts
     
    Corner Caster Kits
    
    Requirement
    
    -Each Set to include 4 wheel caster assemblies;  
    -Can move up to 12,000 lbs; and
    -Casters attached with quick-release pins through detent rails.
    
    Item #1 Shelf Assembly
    
    The Shelf assembly must be 38.5 x 50.06 Inch.
      
    Item #2 Shelf Assembly
    
    The Shelf assembly must be 40.06 x 48.5 Inch.
      
    4. Applicability of the tradeagreement(s) to the procurement
    
    The procurement is subject to the following trade agreements:

    5. Justification for the Pre-Identified Supplier
    
    The pre-identified supplier is the only supplier that we are aware of who offers a product which meets all the Minimum Essential Requirements listed above in point number 3.
    
    6. Government Contracts Regulations Exception(s)
    
    The following exception(s) to the Government Contracts Regulations is invoked for this procurement under subsection 6 (d) - onlyone person is capable of performing the contract.
    
    7. Exclusions and/or Limited Tendering Reasons
    
    The following exclusion(s) and/or limited tendering reasons are invoked under the:
    
    a.) Agreement on Internal Trade (AIT) Article 506.12 (b)"Where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists." 
    b.) North American Free Trade Agreement (NAFTA) Article 1016 2 (b) "where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists." 
    c.) WTO-Article XV: Limited Tendering, 1. b) when, for works of art or for reasons connected with protection of exclusive rights, such as patents or copyrights, or in the absence of competition for technical reasons, the products or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists.
    
    8. Delivery Date
    
    Preferred delivery before March 31, 2016.

    An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award.  However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
    
    Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any procurement.
    
    Documents may be submitted in either official language of Canada.
