An Advanced Contract Award Notice (ACAN) is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of requirement This contract addresses the need to provide a modernized version of the AVAST target echo strength prediction software to support the activities of DRDC Atlantic with respect to a proposed international effort (Benchmark Target Strength Simulation or BeTSSi) to benchmark this type of software being hosted by Germany in 2014/2105. As a participant in this activity, DRDC Atlantic requires assistance in developing the required benchmark models and upgrades to the existing AVAST software to be able to perform the necessary numerical predictions. The work necessary includes upgrading AVAST to work under the Windows 7 operating system, developing a 64-bit version of AVAST, producing the required BeTSSi target echo strength models, producing associated TES models as required, and developing a benchmarking system for the AVAST code in general. The suggested contractor developed AVAST under previous contracts and has unique knowledge necessary to implement the enhancements required. 3. Criteria for assessment of the Statement of Capabilities Any interested supplier must demonstrate by way of a statement of capabilities that its services meets the the requirements that are detailed herein. 4. Justification for the Pre-Identified Supplier MARTEC Ltd. of Halifax has considerable experience in using the AVAST computer codes required for this work and is the sole developer of the AVAST software. The work of this present contract stems from related work produced by MARTEC Ltd. in previous contracts where the development of the present AVAST code was undertaken. Their knowledge of the required computer softwawre and of the research to be conducted for this contract give them a unique capability required for the contract's successful completion. 5. Government Contracts Regulations Exception(s) The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work". 6. Ownership of Intellectual Property Canada intends to retain ownership of any Foreground Intellectual Property arising out of the proposed contract, under the following Exceptions: (6.4.2) the main purpose of the contract, or of the deliverables contracted for, is to augment an existing body of Canada's background information as a prerequisite to the transfer of the augmented background to the private sector, through licensing or assignment of ownership (not necessarily to the original contractor), for the purposes of commercial exploitation; (6.4.3) the main purpose of the contract, or of the deliverables contracted for, is to deliver a component or subsystem that will be incorporated into a complete system at a later date, as a prerequisite to the planned transfer of the complete system to the private sector, through licensing or assignment of ownership, for purposes of commercial exploitation; 7. The period of the proposed contract The proposed contract is from the date of contract award, to March 31, 2014. 8. A cost estimate of the proposed contract The estimated value of the contract is $90,000.00 (GST/HST extra). 9. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 11. The closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is December 5th, 2013 at 2:00 P.M. ADT. 12. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
