An Advanced Contract Award Notice (ACAN) is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of requirement DRDC is studying the role that planning tools could play in enabling unmanned maritime systems to collaborate through a common mission plan. DRDC is also interested in these planning tools as a component of the on-board vehicle autonomy framework. DRDC is representing Canada in several upcoming international trials in 2014. At these trials, the participants from the United Kingdom and the United States will bring AUVs that use the SeeByte NEPTUNE planning tools. An objective of the trial is to demonstrate that unmanned maritime vehicles, equipped with SeeByte NEPTUNE and the WHOI micromodems, are capable of communicating and inter-operating regardless of the autonomous vehicle type, brand, middleware, sensors, etc. The main tasks of this contract are to implement logging of sonar data from the DRDC IVER2 AUV within the SeeByte NEPTUNE. The DRDC IVER2 AUV has NEPTUNE integrated on-board. As well, a new behavior has to be developed for the SeeByte NEPTUNE to allow an AUV that has missed a waypoint, because of its finite turn radius, to re-acquire the waypoint. 3. Criteria for assessment of the Statement of Capabilities Any interested supplier must demonstrate by way of a statement of capabilities that its services meets the the requirements that are detailed herein. 4. Justification for the Pre-Identified Supplier Martec Ltd. has a teaming agreement with the NEPTUNE OEM, SeeByte Ltd. and has worked with them for the last two years. Martec Ltd. is the only company in Canada that has worked with the SeeByte SeeTrack and NEPTUNE planning tools. NEPTUNE is a plug-in for SeeTrack Military and Martec Ltd. has proven experience developing modules for SeeTrack Military. Martec Ltd. was also the prime contractor for integrating the DRDC IVER2 AUV with the NEPTUNE planning tools. Due to their experience and background with SeeTrack Military and NEPTUNE and the fact that they are the only Canadian vendor that is familiar with NEPTUNE, DRDC recommends the contract for this proposal be awarded to Martec Ltd. 5. Government Contracts Regulations Exception(s) The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work". 6. Ownership of Intellectual Property This requirement has been reviewed in accordance with "Basis For DRDC Ownership of Intellectual Property Arising From DRDC Contracts" form and it has been determined that the Intellectual Property arising from this requirement should rest with the Crown. Canada intends to retain ownership of any Intellectual Property arising out of the proposed contract, under the following Exceptions: (6.4.2) the main purpose of the contract, or of the deliverables contracted for, is to augment an existing body of Canada's background information as a prerequisite to the transfer of the augmented background to the private sector, through licensing or assignment of ownership (not necessarily to the original contractor), for the purposes of commercial exploitation; 7. The period of the proposed contract The proposed contract is from the date of contract award, to March 31, 2014. 8. A cost estimate of the proposed contract The estimated value of the contract is $35,000.00 (applicable taxes extra). 9. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 11. The closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is February 6th, 2014 at 2:00 P.M. ADT. 12. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
