Title: Provision of QL3 Aircraft Structures Technician Training to be Provided in French 1. An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of requirement The Department of National Defence has a requirement for the provision of QL3 Aircraft Structures Technician Training to be provided in French. To supplement Canadian Forces School of Aerospace Technology and Engineering(CFSATE) production ability, the Department of National Defence requires instructional services for apprentice-level QL3 Aircraft Structures Technicians. This training must be delivered at a Contractor's training asite. The language of instruction is French. The students must have access to administrative, medical, dental and other support services that are unique to the military environment. The Contractor's training site must therefore be located within a 50 km radius of a Canadian military establishment capable of supporting the number of students selected for the training. Location of Training: Montreal, Quebec The crown intends that the training take place at a contractor's facility. One of the limitations leading to the requirement was facility capacity at CFSATE. The training plan for the training given at CFSATE can be provided as an appendix to the ACAN upon request. The training does not involve military-unique systems and can be provided in the context of either military or civilian aircraft. CFSATE will continue to provide English-language trainng and the military-unique portions of the training that are not associated with the civil occupation. This service can be done outside of Quebec. Ottawa is a military establishment. 3. Criteria for assessment of the Statement of Capabilities Minimum Essential Requirements Any interested supplier must demonstrate by way of a statement of capabilities that its services meets the following requirements: Must provide the required training in full French language apprentice level instructional services for Aircraft Structures Technicians. 4. Justification for the Pre-Identified Supplier Consultation with the Association of Canadian Community Colleges has determine that the pre-identified supplier is the only provider capable of delivering the required training in French. 5. Applicability of the trade agreements to the procurement This procurement is subject to the following trade agreements: Agreement on Internal Trade (AIT), North American Free Trade Agreement (NAFTA), Canada-Chile, Canada-Peru and Canada-Colombia trade agreements and World Trade Organization Agreement on Government Procurement (WTO-AGP) 6. Set-aside under the Procurement Strategy for Aboriginal Business This requirement is not subject to a set-aside under the procurement strategy for Aboriginal Business. 7. Comprehensive Land Claims Agreement(s) Comprehensive Land Claim Agreements does not apply to this procurement. 8. Government Contracts Regulations Exception(s) The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work 9. Exclusions and/or Limited Tendering Reasons The following exclusion and/or limited tendering reasons are invoked under the section of the trade agreements specified: Agreement on Internal Trade (AIT) - Article 506 paragraph 11 and 12. North American Free Trade Agreement (NAFTA) - Article 1016(1.b) World Trade Organization Agreement on Government Procurement (WTO-AGP) - Article XV(1.b) 10. Suppliers' right to submit a statement of capabilities Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN, may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 12. The closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is March 20, 2013 at 2:00 P.M. ADT 13. The period of the proposed contract The proposed contract is for an initial period of two(2) years with three(3) additional one(1) year periods. 15. A cost estimate of the proposed contract The estimated value of the contract, is $2,000,000.00 (GST/HST extra). This PWGSC office provides procurement services to the public in English. Delivery Date: Above-mentioned You are hereby notified that the government intends to negotiate with one firm only as identified above. Should you have any questions concerning this requirement, contact the contracting officer identified above. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
