Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement Public Works and Government Services has a requirement for services to ensure the availability, delivery and/or access, and set-up of an Emergency Operations Centre (EOC)/alternate site facility for one or multiple PWGSC locations at: 1713 Bedford Row, Halifax, Nova Scotia; 1045 Main St, Moncton, New Brunswick; 189 Prince William St, Saint John, New Brunswick; 3 Queen St, Charlottetown, Prince Edward Island; 10 Barter’s Hill, Newfoundland. 3. Objectives To establish an emergency operations centre/alternate work site to ensure continuity of services for Public Works and Government Services Canada operations in the Atlantic Region in case of damage to any, or all (as required depending on the specific emergency situation), of the main office sites in the four Atlantic provinces including 1713 Bedford Row, Halifax, Nova Scotia; 1045 Main St, Moncton, New Brunswick; 189 Prince William St, Saint John, New Brunswick; 3 Queen St, Charlottetown, Prince Edward Island; 10 Barter’s Hill, Newfoundland. 4. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) Any interested supplier must demonstrate by way of a statement of capabilities that its product/ equipment/system (as appropriate) meets the following requirements: The EOC/alternate site facility must meet the requirements listed below and be available immediately, as required, on contract award. • Mobile or fixed office space for between 40-48 people located as close to the office site as possible (preferably immediately beside but to within 20 km), depending on the extent of the damage caused by the emergency event/disaster and accessibility to the site • Office space must already be outfitted with basic office equipment (desks, chairs, phones at a minimum, etc ) • Office space must provide 120V emergency backup power for that office space , i.e. generator, in order to operate computer systems, lighting and provide 110V electrical power to existing electrical outlets • A pre-existing contract must be in place by the contractor for delivery of fuel for the generator • Office space must have a Heating, Ventilation & Air Conditioning (HVAC) system. • Office space must have available satellite telephone lines/access. • Office space must have existing internet connection/access. • Office space must have on-site operational printer and fax. • Contractor must have availability of notebook/laptopcomputers with Windows 7, minimum processors of Intel Core i3, including MS Office Suite, MS Outlook • Contractor must have on-call 24-7 point of contact for establishment and set up of alternate site. • If contractor is providing a mobile site, contractormust be able to search out and secure a location to set-up the mobile site if a location cannot be provided by PWGSC Atlantic. • Contractor must provide all costs for deployment of equipment to PWGSC for approval, and receive approval, before deployment. • Contractor must have possibility of technical support if Shared Services Canada is overwhelmed depending on specific emergency. • Contractor must have services related to conducting Exercises for the testing and verification of operational plans, equipment, and functionality of the alternate office space. • Contractor must offer individual recovery services related to a lack of power, communications, technology, or space. • If EOC/alternate site is mobile, contractor must, when authorized by PWGSC that it is no longer required, disconnect, disassemble and/or remove mobile site and any related equipment from temporary location. 5. Applicability of the trade agreement(s) to the procurement This procurement is subject to the following trade agreements: NAFTA/AIT/Canada FTAs with Peru/Colombia/Panamae Agreements 6. Set-aside under the Procurement Strategy for Aboriginal Business N/A 7. Comprehensive Land Claims Agreement(s) N/A 8. Justification for the Pre-IdentifiedSupplier It is the Canada’s intention to award a Contract to : Agility Recovery Solutions Ltd. 1090 Brevik Place Mississauga, Ontario L4W3Y5 Canada The only known supplier of this type of infrastructure equipment along with exercise planning facilitation. The Vendor owns the intellectual property rights of the MyAgility’ online planning service they provide as part of their package of services. The rest of the service they provide is the provision of physical infrastructure equipment and Exercise planning facilitation. By obtaining their services, PWGSC will have the right to use the MyAgility planning service included in the contract if we choose. 9. Government Contracts Regulations Exception(s) The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work. 10. Exclusions and/or Limited Tendering Reasons The following exclusion(s) and/or limited tendering reasons are invoked under the: Agreement on Internal Trade (AIT) Article 506.12 (b) North American Free Trade Agreement (NAFTA) Article1016.2 (b) 11. Ownership of Intellectual Property N/A 12. Period of the proposed contract or delivery date Upon contractaward, services will be provided on an as need basis necessary for recovery, for a period of one year with a one year option period. 13. Suppliers' right to submit a statement of capabilities Suppliers who consider themselves fully qualified and available to providethe goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearlydemonstrate how the supplier meets the advertised requirements. 14. Closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is March 31st, 2016 at 2:00 p.m. EST. 15. However, should a Statement of Capabilities be found to meetthe requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
