Telephone No. - (902) 403-3918 Articulating Solar Panels Smartflower Solar panel unit, purchase of at least one unit, to a maximum of three units. 1. Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement Public Services and Procurement Canada, on behalf of the Department of Fisheries and Oceans and the Canadian Coast Guard, has a requirement to purchase at least one, and as many as three, SmartFlower Solar unit for installation at the Canadian Coast Guard College in Sydney, Nova Scotia. It is intended to negotiate a contract with Nu-NRG Corporation, Toronto, Ontario; Canadian distributor for Smartflower Solar. The Contractor must provide one Smartflower that will be used to supplement electricity consumption at the Canadian Coast Guard College in Sydney Nova Scotia. 3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) Any interested supplier must demonstrate by way of a statement of capabilities that its equipment meets the following requirements: 3.1. The unit must produce a nominal energy output of 2.50 kWp 3.2. The expected annual energy output is to be in the range of 3800 to 6200 kWh/a 3.3. The unit must operate in a temperature range of -20 C and 50 C. 3.4. The unit must operate safely in winds up to 50 km/hr 3.5. The unit must be able to be secured to the site via earth screws or a concrete foundation (by others). 3.6. The module performance warranty is 25 years with a guaranteed electrical production for 10 years of 90% of rated power output and 25 years at 80%. 3.7. The system warranty shall be a minimum of 5 years (5 years parts and 2 years labour) 3.8. The unit shall articulate to follow the sun across the sky to capture the maximum solar energy 3.9. The unit shall close during inclement weather 3.10. The unit installation shall include connection to a facility electrical panel and include a method to measure the energy production provided by the solar flower. 3.11. The supplier will provide a technician to oversee installation at site at a later date (in the spring) including but not limited to: Start-up, testing, commissioning, demonstration and basic user testing. 3.12. The unit will require a 20A split phase 12-/240V 1 Phase 3W power source for operation. 3.13. The unit supplied shall be CSA approved as a complete unit. 4. Applicability of the trade agreement(s) to the procurement This procurement is subject to the following trade agreement(s): a. Canadian Free Trade Agreement (CFTA) b. North American Free Trade Agreement (NAFTA) 5. Justification for the Pre-Identified Supplier The Canadian Coast Guard College considered installing solar panels on the roof of the campus in an effort to reduce their carbon footprint and overall energy consumption. A Study was completed and the orientation and slope of the campus roofs was found to be not suitable for roof mounted solar panels. The option of using a Solar flower style mechanism which articulates and follows the sun across the sky, such as the Smartflower has been researched by PSPC on behalf of the CCGC and the decision was made to purchase one Smartflower. The company Nu-NRG Canada is the only certified distributor of the Smartflower product in Canada. This is new technology to North America, and to the best of PSPCs knowledge only Nu-NRG has certified installers and the licence to distribute this equipment in Canada. 6. Government Contracts Regulations Exception(s) The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work"). 7. Exclusions and/or Limited Tendering Reasons: The following exclusion(s) and/or limited tendering reasons are invoked under the: Canadian Free Trade Agreement (CFTA) Article 513 1(b)(iii), due to an absence of competition for technical reasons; and North American Free Trade Agreement (NAFTA) Article1016 (b), where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists. 8. Period of the proposed contract or delivery date The product, including installation and on-site training, must be delivered on or before March 31, 2018. 9. Cost estimate of the proposed contract The estimated value of the contract is $30,000 for one Smartflower (GST/HST extra). The total maximum potential contract value is estimated at $90,000. 10. Suppliers' right to submit a statement of capabilities Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 12. Closing date for a submission of a statement of capabilities Note above. 13. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
