Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of requirement Public Works and Government Services Canada on behalf of Department of National Defence - DRDC Atlantic has a requirement for the supply and delivery of Acoustic Releases as specified under "background" below. The purpose of this Advance Contract Award Notice (ACAN) is to signal the government's intention to award a contract for this good to Sub Sea Sonics, LLC El Cajon, California, USA. Before awarding a contract, however, the government would like to provide other suppliers with the opportunity to demonstrate that they are capable of satisfying the requirements set out in this Notice, by submitting a statement of capabilities during the 15 calendar day posting period. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. Background Sub Sea Sonics, LLC is the only known supplier of suitable low cost acoustic release units. Sub Sea Sonics Acoustic Releases are a low-load, shallow water ideally suited for DRDC requirements. The delivery is to be to DRDC Atlantic 9 Grove Street, Dartmouth, Nova Scotia B3A 3C5 The contractor must provide and complete all aspects of delivery by March 27, 2015, including delivery and transport. 3. Criteria for assessment of the Statement of Capabilities Minimum Essential Requirements Any interested supplier must demonstrate by way of statement of capabilities that it meets the following requirements: Acoustic Releases Deliverable: The Acoustic Releases must meet the below criteria: Be for low-load, shallow water with a low cost. The Model numbers from Sub Sea Sonics are as follows: Model AR-60-E Acoustic Release underwater release unit, batteries included. LKH-162 Release link for AR-60-E. 160 lb. Load, .035 Diameter Stainless Steel Wire LKH-262 Release Link for AR-60-E. 200 lb. Load, .045 Diameter Stainless Steel Wire. LKH-172-NI Release Link for AR-60-E. 170 lb. Load, .035 Diameter 60% Nickel Wire. LKH-202-NI Release Link for AR-60-E. 170 lb. Load, .045 Diameter 60% Nickel Wire. 4. Applicability of the trade agreement(s) to the procurement This procurement is subject to the following trade agreements: Agreement on Internal Trade (AIT) North American Free Trade Agreement (NAFTA) 5. Justification for the Pre-Identified Supplier Sub Sea Sonics, LLC, is the only known commercial organization available solution capable of providing the Acoustic Releases with the ability to complete all of the associated deliverables stated under Section 3 - Statement of Capabilities, and by the delivery date specified above. 6. Government Contracts Regulations Exception: The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - only one person is capable of performing the work. 7. Exclusions and/or Limited Tendering Reasons The following exclusion(s) and/or limited tendering reasons are invoked under the section of the trade agreement(s) specified: Agreement on Internal Trade (AIT) Article 506.12b) where only one supplier is able to meet the requirements of procurement, an entity may use procurement procedures that are different from those described in paragraphs 1 through 10 in the following circumstances: (b) where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists; North American Free Trade Agreement (NAFTA) Article 1016: Limited Tendering Procedures. An entity may use limited tendering procedures in the following circumstances and subject to the following conditions, as applicable: (b) where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists; World Trade Organization - Agreement on Government Procurement (WTO-AGP) Article XV Limited Tendering Procedures. An entity may use limited tendering procedures in the following circumstances and subject to the following conditions, as applicable: (b) when, for works of art or for reasons connected with protection of exclusive rights, such as patents or copyrights, or in the absence of competition for technical reasons, the products or services can be supplied only by a particular supplier and no reasonable-alternative or substitute exists. 8. The period of the proposed contract or the delivery date(s) The products must be delivered on or before March 27, 2015. The period of the contract is from date of contract award to March 27, 2015. 9. A cost estimate of the proposed contract. The estimated value of the contract is $60,943.00 USD (Applicable Taxes extra). 10. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 12. The closing date for a submission of a statement of capabilities. The closing date and time for accepting statements of capabilities is December 30, 2014 at 2:00 p.m. 13.
