    An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a statement of capabilities that meets the requirements set out in the ACAN, the competitive requirements of the government’s contracting policy have been met. Following notification to suppliers not successful in demonstrating that their statement of capabilities meets the requirements set out in the ACAN, the contract may then be awarded using the Treasury Board’s electronic bidding authorities. If other potential suppliers submit statements of capabilities during the fifteen (15) calendar day posting period, and meet the requirements set out in the ACAN, the department or agency must proceed to a full tendering process on either the government’s electronic tendering service or through traditional means, in order to award the contract.
    
    The purpose of this Advance Contract Award Notice (ACAN) is to signal the Department of National Defence’s intention to award a contract to:

    The requirement involves the purchase and delivery of three (3) ergonomic pallet strapping machines that can be operated by a single person, allowing them to strap pallets in a standing position without having to bend over. All three machines are the ErgoStrap Ergonomic Pallet Strapping System 740E, Model 2018. The requirement also includes a battery module, a spare battery, a charger and an attachment for lifting smaller pallets for each machine. 
    
    The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) "only one person is capable of performing the contract".
    
    The following exclusions and/or limited tendering reasons are invoked under the:
    
    Agreement on Internal Trade (AIT)  Article 506.12(b) "where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists";
    
    North American Free Trade Agreement (NAFTA)  Article 1016.2(b)
    "where for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists".
    
    Strapco Inc. the sole Canadian distributor of ErgoStrap pallet strapping machines, which is believed to be the only manufacturer to produce ergonomic pallet strapping machines that allow a single operator to strap pallets while in a standing position.
    
    The value of the purchase is estimated to be $89,000 Cdn including taxes.
    
    This procurement is subject to the North American Free Trade Agreement (NAFTA) and the Canadian Free Trade Agreement (CFTA). 
    
    It is mandatory that the delivery date is on or before March 31, 2020.
    
    Any other potential supplier must demonstrate by way of a statement of capabilities that its product meets the following:
    
    Minimum Essential Requirements of the Statement of Capabilities:
    
    • Machine must allow a single operator to strap pallets while in a standing position, not requiring the operator to bend over.
    
    • Machine must be capable of strapping standard pallets and pallets under 80cm as well.
    
    Suppliers who consider themselves fully qualified and available to provide the goods described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice.  The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.

    Statements of capabilities must be received on or before 14:00 Atlantic Standard Time, December 13, 2019. Statements of capabilities received on or before the closing date will be considered solely for the purpose of deciding whether or not to conduct a more extensive tendering process. Information provided will be used by the Crown for technical evaluation purposes only with respect to a decision to proceed to a further competitive process.
    
    Suppliers that have submitted a statement of capabilities will be notified in writing of DND's decision to proceed to award the contract without a further additional competitive process.

However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
    
    Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any procurement.
    
    Documents may be submitted in either official language of Canada.
