    On behalf of the Department of Natural Resources Canada (NRCan), Public Services and Procurement Canada (PSPC) is using the Advance Contract Award Notice (ACAN) process for this requirement, to indicate to the supplier community that it intends to award a contract to a pre-identified supplier as the requirement is subject to certain exceptions from both the Government Contracts Regulations and the Canadian Free Trade Agreement.
    
    This process is being enacted to allow other suppliers to signal their interest in bidding, should they be able to demonstrate their ability to meet the stated requirements of the supply of Thermoelectric Generators to NRCan in Ottawa, Ontario, in their submission of a Statement of Capabilities that conforms to the advertised requirements detailed herein, by the closing date and time of this public notice.

    1. ACAN Explanation 
    
    An Advance Contract Award Notice (ACAN) is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a Statement of Capabilities. If no supplier submits a Statement of Capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
    
    2. Definition of the Requirement
    
    The Department of Natural Resources Canada (NRCan) has a need for Thermoelectric Generators, for use by its Canadian Hazards Information Service (CHIS).  CHIS operates the Canadian National Seismic Network (CNSN), which consists of over 100 digital seismograph stations across Canada, and one of these sites is located in a remote area of the northern portion of the west coast of British Columbia in the Haida Gwaii archipelago.  An alternative means of power generation is required as a backup to the solar powered system that is used as the power source, and thermoelectric generators (TEG) are ideal for this situation, as they have no moving parts.  Traditional wind or gas generators will induce seismic noise in the area, making the seismograph station less effective.
    
    As such: two (2) thermoelectric generators, and one (1) pole mount stand for same, that are equivalent to Gentherm Global Power Technologies’ part no. P-5100-L-12-RS-FA and its associated pole mount stand, are required for delivery to NRCan in Ottawa, Ontario by August 13, 2018.
    
    3. Criteria for Assessment of the Statement of Capabilities (Minimum Essential Requirements)
    
    Any interested supplier must clearly demonstrate, by way of a Statement of Capabilities, that its product/equipment/system (as appropriate) meets the following requirements of the Thermoelectric Generators to be provided, as these are the criteria against which potential suppliers will be assessed:
    
    A) Fuel:
         1) Operate on Liquefied Propane Gas (LPG);
         2) Maximum pressure 50 psi at the TEG;
         3) Maximum consumption rate 14 litres/Day;
    B) Operation:
         4) CSA Std. T.I.L. R-10 for outdoor operations;
         5) Autonomous operations;
         6) Automatic start-up on low battery voltage;
         7) Automatic shutdown on a fully charged battery;
         8) Acceptance of manual start and stop commands from remote and local interfaces.  Digital inputs from a user supplied SCADA (Supervisory Control and Data Acquisition) unit for remote commands and toggle or pushbutton switches from the TEG supplier for local commands;
         9) Remote and local operating status indicators of the TEG. Digital outputs connected to a user supplied SCADA unit for remote status indication and lights or other types of displays from the TEG supplier for local indicators;
    C) Power:
         10) Minimum power output, 100 Watts at 12 VDC; and
         11) Nominal output voltage 12VDC, adjustable up to 15V DC minimum.
    
    4. Applicability of Trade Agreement(s) to the Procurement
    
    This procurement is subject to the Canadian Free Trade Agreement (CFTA).
    
    5. Applicability of Set-Aside under the Procurement Strategy for Aboriginal Business
    
    This procurement is not a set-aside for an Aboriginal supplier, in accordance with the government Procurement Strategy for Aboriginal Business (PSAB).
    
    6. Applicability of Comprehensive Land Claims Agreement(s)
    
    This procurement is not subject to Comprehensive Land Claims Agreement(s).
    
    7. Justification for the Pre-Identified Supplier
    
    A thermoelectric power source for both installation and use in unattended and remote outdoor locations is required, such as Thermoelectric Generators with CSA Std. T.I.L. R-10 certification for outdoor operations, of which Gentherm Global Power Technologies Inc. is the only supplier currently known to be capable of meeting this requirement for the requested delivery date.
    
    8. Government Contracts Regulations Exception(s)
    
    The following exception(s) to the Government Contracts Regulations is invoked for this procurement, under subsection 6:
    
     d) - "only one person is capable of performing the contract".
    
    9. Exclusions and/or Limited Tendering Reasons
    
    The following exclusion(s) and/or limited tendering reasons are invoked under the Canadian Free Trade Agreement (CFTA), Article 513 section 1:
    
    b) "if the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute goods or services exist for any of the following reasons:
    ...iii) due to an absence of competition for technical reasons".
    
    10. Ownership of Intellectual Property
    
    No intellectual property will be created during the course of the contract.
    
    11. Period of the Proposed Contract or Delivery Date
    
    The equipment is requested to be delivered to NRCan in Ottawa, Ontario by August 13, 2018.
    
    12. Cost Estimate of the Proposed Contract
    
    The estimated value of the contract, including any projected option(s), is $24,000 CAD (GST/HST extra).

    Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a Statement of Capabilities, in writing, to the contact person identified in this notice on or before the closing date of this notice.
    
    The Statement of Capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    15. Closing Date for Submission of a Statement of Capabilities
    
    The closing date and time for accepting Statements of Capabilities is Friday, July 20, 2018 at 2:00pm EST.

    You are hereby notified that the government intends to negotiate with one firm only as identified above. Should you have any questions concerning this requirement, contact the contracting officer identified above.
    
    An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award.  However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
    
    Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any procurement.
