Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement Environment Canada has a requirement for the supply of one Snow Specific Surface Area (SSA) Measurement System for research use in various locations in the Canadian arctic. The IceCube from A2 Photonic Sensors is a commercially available snow SSA measurement device that is easily transportable and suitable for usage in a variety of environments and uses 1310nm laser reflectometry to determine snow SSA in the field. Environment Canada requires that one IceCube device be delivered on or before February 1st 2019. 3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) Any interested supplier must demonstrate by way of a statement of capabilities that its product meets the following requirements: Technical Requirements: Measurement and Analysis: (a) The unit must measure the specific surface area of snow using laser reflectometry (b) Uncertainty of the measurement must be <10% between 5% and 99% reflectance (c) The unit must be able to accept external snow samples for measurement. Physical: (a) The physical dimensions of the unit must be: a. Width - 30cm or less b. Depth - 30cm or less c. Height - 30cm or less (b) The unit must weigh 10 kg or less, with the weight of the battery not included. (c) The unit must be portable. Temperature: (a) The unit must be able to operate at temperatures ranging from -40 °C or lower to 20°C or higher. Power: (a) The unit must be battery powered (b) The battery must be rechargeable by plugging it into a standard 110-220 VAC electrical outlet (c) The unit must be able to run for a minimum of 24 hours at a time, either by using a single battery or by switching out replaceable batteries with a minimum lifespan of 6 hours each. Calibration and Display: (a) The unit must have a display that shows, at minimum, the output voltage of the laser reflectometer. (b) The unit must be able to use external reflectance standards for the calibration of the laser reflectometer. 4. Applicability of the trade agreement(s) to the procurement This procurement is subject to the following trade agreement(s): o Canadian Free Trade Agreement (CFTA) o North American Free Trade Agreement (NAFTA) 5. Justification for the Pre-Identified Supplier The company "A2 Photonic Sensors" is the only authorized distributor of IceCube device. Thus, according to the purchasing policies of Government Contracts, PSPC proposes to award the contract to "A2 Photonic Sensors ", that is, to our knowledge, the only company able to provide the required goods. 6. Government Contracts Regulations Exception(s) The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6 (d) - "only one person is capable of performing the contract." 7. Exclusions and/or Limited Tendering Reasons The following exclusion(s) and/or limited tendering reasons are invoked under the: o Canadian Free Trade Agreement (CFTA) - Article 513 (1) o North American Free Trade Agreement (NAFTA) - Article1016 Section 2 (b) 8. Period of the proposed contract or delivery date o The product must be delivered on or before February 1st, 2019 9. Cost estimate of the proposed contract The estimated value of the contract is $35,000.00 (GST/HST extra). 10. Suppliers' right to submit a statement of capabilities Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 12. Closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is November 21, 2018, an 2:00 PM EST. 13. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
