Trade Agreement: NAFTA/AIT/Canada FTAs with Peru/Colombia/Panama Tendering Procedures: Generally only one firm has been invited to bid Attachment: None Non-Competitive Procurement Strategy: Exclusive Rights Comprehensive Land Claim Agreement: No Vendor Name and Address: Folio Instruments Inc. 277 Manitou Dr. Unit A Kitchener Ontario Canada N2C1L4 Nature of Requirements: Solicitation Number: 01E91-140288 Title: Glycemic Index and Resistant Starch Analyzer Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. Requirement Agriculture & Agri-Food Canada, Guelph Food Research Centre, Guelph, Ontario, has a requirement for the supply and delivery of an Automated In Vitro Glycemic Index (GI) and Resistant Starch (RS) Analyzer system. The instrument simulates human digestion and, with the addition of enzymes and buffers, breaks down starchy foods to glucose, which is measured via an online monitor, then ultimately calculates their glycemic index and resistant starch content (i.e. foods that qualify for in vivo GI testing). Statement of Capabilities Any interested supplier must demonstrate by way of a statement of capabilities that its product meets the following Minimum Mandatory Specifications for an Automated In Vitro Glycemic Index (GI) and Resistant Starch (RS) Analyzer: - The GI/RS Analyzer must be automated, programmable, and computer controlled. - The GI/RS Analyzer must have the capacity to simultaneously analyze a minimum of 10 (ten) starchy high carbohydrate food samples. - The GI/RS Analyzer must have an automated GI Determination Function. - The GI/RS Analyzer must have an automated RS Determination Function. - The GI/RS Analyzer must have good analytical precision with an inter-assay coefficient of variation (CV) of between 7% and 12%. - The GI/RS Analyzer must be able to do glucose analysis with a high level of accuracy and precision as evident by an inter-assay coefficient of variation (CV) of between 1% and 6%. - The bidder's bench top GI/RS system (including computer) must not exceed 1500 mm wide, 900 mm depth and 1500mm high. The supplier must also supply a computer system, monitor, and software for the GI/RS system, to provide complete control and data acquisition. The computer, monitor, and software must meet the following Minimum Mandatory Specifications: Computer: - CPU inter core I7-3770with 8 meg cache, 3.0 GHZ - 8 gig memory 1600 MHZ (2 module) - Minimum 250 gig 3.5 SATA - Integrated network card - 1 gig memory for video - Minimum of 6 USB ports - Minimum 16x DVD +/-RW drive - 3 year support and 3 year next business day on-site warranty. Monitor: - Size: 22 - 24" monitor - Speaker: built in speaker - Port : minimum one USB port - Resolution: 1920 x 1080 - Connectivity: VGA and DVI The system must have the necessary cables for communication with associated equipment. Software: - The operating system must be compatible with Window 7 Professional, 64 bit; if not available 32 bit to ensure compatibility with local area network. - The software must have the application and methods for glycemic index determinations. - The software must have the application and methods for resistant starch determinations. - All software updates and new releases must be provided for a period of one year following the acceptance. Trade Agreements This procurement is subject to the following trade agreements: the North American Free Trade Agreement (NAFTA) and the Agreement on Internal Trade (AIT). Justification for the Pre-Identified Supplier The pre-identified supplier has been identified as the only supplier capable of providing an Automated In Vitro Glycemic Index (GI) and Resistant Starch (RS) Analyzer meeting the required specifications as detailed above. Government Contracts Regulations Exception The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6 (d) - "only one person is capable of performing the work". Limited Tendering Reasons The following limited tendering reasons are invoked: NAFTA: Article 1016: (2b) where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists. AIT: Article 506, (12b) where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no alternative or substitute exists. Delivery Date 8 weeks ARO Value The estimated value of the contract is $110,000.00 to $140,000.00 + applicable taxes. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. Closing date for a submission of a statement of capabilities: January 13th, 2014. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
