    Nature of Requirements: 
    
    1.  Advance Contract Award Notice (ACAN) 
    
    An ACAN is a public notice indicating to the supplier community
    that a department or agency intends to award a contract for
    goods, services or construction to a pre-identified supplier,
    thereby allowing other suppliers to signal their interest in
    bidding, by submitting a statement of capabilities. If no
    supplier submits a statement of capabilities that meets the
    requirements set out in the ACAN, on or before the closing date
    stated in the ACAN, the contracting officer may then proceed
    with the award to the pre-identified supplier. 
    
    2.  Requirement 
    
    The Military Personnel Generation Training Group (MPGTG) in
    coordination with the Mapping and Charting Establishment (MCE) -
    School of Military Mapping (SMM) require the delivery of a
    training program that will satisfy the occupation performance
    requirements for the Canadian Armed Forces (CAF) Geomatics
    Technician. The contracted service provider will develop and
    deliver a training program exclusively for CAF personnel that
    will satisfy the Qualification Level 5A Geomatics Technician
    performance requirements as defined in the Performance
    Objectives detailed in the CAF Qualification Standard. In
    addition, the program must satisfy requirements for a
    post-secondary community college approved certificate in
    geomatics, which culminates in a provincially approved diploma
    in geomatics. In order to provide training and information in
    military context, it will be necessary for CAF personnel from
    the School of Military Mapping to use the service provider's
    facilities to supplement the training provided to incorporate a
    military perspective. It is necessary that the contracted
    service provider be located within the National Capital Region.
    The only known facility located in Ottawa that can deliver the
    required training resulting in a post secondary community
    college approved certificate in geomatics, which culminates in a
    provincially approved diploma in geomatics, is Algonquin College
    (Ottawa Campus). Consequently, in order to satisfy the
    requirement the intention is to award a contract to Algonquin
    College of Applied Arts and Technology. 
    
    3.  Criteria for assessment of the Statement of Capabilities
    (Minimum Essential Requirements) 
    
    Any interested supplier must demonstrate by way of a statement
    of capabilities that it meets the following requirements: 
    
    1) The Contractor must be within the National Capital Region. 
    2) The Contractor must be recognized as a diploma/degree
    granting institution by the Ontario Ministry of Training,
    Colleges, and Universities. 
    3) The Contractor must be prepared to begin the first program
    start 01 September 2016. 
    4) The Contractor must provide a computer classroom, dedicated
    to military students only, which accommodates a maximum of 30
    students. 
    5) The Contractor must provide office space for 12 CAF SMM
    staff. 
    6) The Contractor must provide instructors that have experience
    with the following program areas: Statistics, Cartography, RSI,
    H/N Geography, 3D Vis, Thematic Mapping and Project Management. 
    7) The Contractor must provide Geomatics training materials that
    include examples of course materials, practical assignments and
    assessment materials such as geodesy, remote sensing,
    photogrammetry, GIS, programming in Python and HTML, web design
    and mobile application, and related database manipulation. 
    8) The Contractor must incorporate practical work sessions
    during the training in order to develop student skills for the
    commonly used geomatics software applications in the
    public/private sectors and that are also common to CAF Geomatics
    Technicians. The software applications include, but are not
    limited to: ERDAS Imagine (including the Leica Photogrammetric
    Suite), ESRI ArcGIS, and Adobe Photoshop.
    
    4.  Applicability of the trade agreements to the procurement 
    
    This procurement is subject to the following trade agreements: 
    
    -Agreement on Internal Trade (AIT) 
    -North American Free Trade Agreement (NAFTA) 
    
    5.  Justification for the Pre-Identified Supplier 
    
    Algonquin College of Applied Arts and Technology has been
    identified as the only supplier capable of meeting the
    requirements as described above. 
    
    6.  Government Contracts Regulations Exception 
    
    The following exception to the Government Contracts Regulations
    is invoked for this procurement under subsection 6(d) - "only
    one person is capable of performing the work". 
    
    7.  Exclusions and/or Limited Tendering Reasons 
    
    -Agreement on Internal Trade (AIT) - Article 506 - Paragraph
    12(b) 
    -North American Free Trade Agreement (NAFTA) - Article 1016 -
    Paragraph 2(b) 
    
    8.  Ownership of Intellectual Property 
    
    Canada intends to retain ownership of any Foreground
    Intellectual Property arising out of the proposed contract, on
    the following grounds: where the material developed or produced
    consists of material subject to copyright, with the exception of
    computer software and all documentation pertaining to that
    software. 
    
    9.  Period of the proposed contract 
    
    The proposed contract is for an initial program period from 01
    September 2016 to 30 June 2018. The proposed contract will
    contain the option for three (3) additional program periods from
    01 September 2017 to 30 June 2019, 01 September 2018 to 30 June
    2020, and 01 September 2019 to 30 June 2021 respectively. 
    
    10.  Suppliers' right to submit a statement of capabilities 
    
    Suppliers who consider themselves fully qualified and available
    to provide the goods, services or construction services
    described in the ACAN may submit a statement of capabilities in
    writing to the contact person identified in this notice on or
    before the closing date of this notice. The statement of
    capabilities must clearly demonstrate how the supplier meets the
    advertised requirements. 
    
    11.  Closing date for a submission of a statement of
    capabilities 
    
    The closing date and time for accepting statements of
    capabilities is:

    An Advance Contract Award Notice (ACAN) allows departments and
    agencies to post a notice, for no less than fifteen (15)
    calendar days, indicating to the supplier community that it
    intends to award a good, service or construction contract to a
    pre-identified contractor. If no other supplier submits, on or
    before the closing date, a Statement of Capabilities that meets
    the requirements set out in the ACAN, the contracting authority
    may then proceed with the award.  However, should a Statement of
    Capabilities be found to meet the requirements set out in the
    ACAN, then the contracting authority will proceed to a full
    tendering process.
    
    Suppliers who consider themselves fully qualified and available
    to provide the services/goods described herein, may submit a
    statement of capabilities in writing to the contact person
    identified in this Notice on or before the closing date of this
    Notice. The statement of capabilities must clearly demonstrate
    how the supplier meets the advertised requirements.
    
    The PWGSC file number, the contracting officer's name and the
    closing date of the ACAN must appear on the outside of the
    envelope in block letters or, in the case of a facsimile
    transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any
    procurement.
