If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. Definition of the requirement The Department of Agriculture and Agri-Food, located at 850 Lincoln Rd, Fredericton, New Brunswick, has a requirement for the supply, delivery, installation, training and warranty of one (1) carbon and nitrogen analyzer with the following specifications: 1. Analyzes up to 1 g or more of organic sample 2. Analyzes up to 4ml of aqueous sample in a 5 ml open reusable crucible. 3. Analyzes 100% of the combustion gases without gas splitting using the Dumas method. 4. Analyzes carbon and nitrogen using either helium or argon (as a gas carrier) but initial set up for helium 5. Electrical of 208 VAC and 60 Hz. 6. Regulator for oxygen (Oxygen consumption of no more than 0.5L O2 per analysis). 7. Regulator for helium (8 bar) 8. Control and evacuation PC English keyboard 9. Consumables and parts for 4000 CN samples 10. Capacity for uninterruptible power supply. 11. CSA inspection fee, installation and training 12. Warranty: 12 months including parts and labor from date of install 13. Software to run instrument included in the purchase and compatible with Windows 10 14. Autosampler capable handling solid and aqueous samples types 15. Autosampler removal of combustion ash after each analysis 16. Uses automatic leak finding software 17. Software uses auto sleep/wake-up 18. Initial outfit kit and starter kit 19. Electronic analytical balance (Mettler-Toledo ME54T) 20. All critical tools for maintenance of the equipment 21. Crucibles (steel, 100 pcs/package) 22. 2x sample trays (90 samples) 23. Interior extractor complete (25.00-0054) Delivery date: Delivery before or on March 31, 2020 This procurement is subject to the following trade agreement(s) o World Trade Organization - Agreement on Government Procurement (WTO-AGP) o North American Free Trade Agreement (NAFTA) o Canada-European Union Comprehensive Economic and Trade Agreement (CETA) o Canadian Free Trade Agreement (CFTA) 5. Government Contracts Regulations Exception(s) The following exception(s) to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - only one person is capable of performing the work. 6. Ownership of Intellectual Property Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in the Contractor. 7. Period of the proposed contract or delivery date o The equipment must be delivered before or on March 31, 2020. The estimated value of the contract is $114,552.91 (GST/HST extra). 8. Suppliers' right to submit a statement of capabilities Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 10. Closing date for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is November 6, 2019 at 2:00 p.m. Atlantic). 11. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
