    Advance Contract Award Notice (ACAN) 
    
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 
    
    1. Definition of the requirement 
    The Department of Fisheries and Oceans Canada - Canadian Coast Guard has a requirement to provide technical investigation and engineering services in support of the development of specifications and procurement management for the higher complexity electrical and electronic work that will be completed during the future Vessel Life Extension of the CCG Vessel Terry Fox. 
    
    As part of the Vessel Life Extension (VLE) program of the Canadian Coast Guard (CCG) fleet the CCG and the Department of Public Services and Procurement Canada (PSPC) will be issuing a solicitation for a VLE refit on the CCGS Terry Fox at a later date.
    
    The current VLE refit Schedule has the vessel undergoing its VLE starting in (date subject to change) late 2022. Canada intends to conduct a competitive procurement process for the VLE and award a contract in early 2022 allowing for an eight month lead time prior to the vessels arrival at the contractor’s facility.
      
    Coast Guard Technical resources are over tasked at this time and need assistance in the development of specifications and procurement management for the higher complexity electrical and electronic work to be completed during the VLE.  The majority of the firms with the level of expertise required to develop the specifications would have higher interest in bidding on the more lucrative implementation phase of the VLE, rather than just the development of the specifications. Due to Government of Canada Regulation, conflict of interest, any company working on the development of the specifications would be precluded from bidding on the next phase.
    
    To ensure a fair competition for the VLE work, Coast Guard requires the services of a firm who would not be bidding on any of the requirements during the implementation phase of the VLE.
     
    PSPC and the CCG propose to enter into a standing offer with Canal Electric of St. Catharines, Ontario to provide as and when required support to the CCG Technical group to define the work that will be carried out by the larger Electrical firms during the implementation phase of the project.
    
    2. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) 
    
    - The supplier must have 5 years’ industry experience in developing specifications for major marine electrical integration projects acquired within the last 5 years prior to the closing date of this ACAN.
    
    -  The supplier must have recent (in the last 2 years) experience working on and knowledge of the electrical systems and major components (switchboards, Shaft generators, Bow and stern thrusters, Control systems, Alarm and monitoring, Etc.)  on the CCGS Terry Fox. This experience must include surveying the vessel’s equipment and developing technical specifications and recommendations related to the systems.
    
    - Due to travel and site visit restrictions due to COVID-19, supplier must be capable of developing specifications without having to travel to and work on the vessel.
    
    - The firm must not be one that would be bidding on delivering components or systems as part of the VLE implementation.
    
    - The supplier must have Professional Engineer Electrical staff available.
    
    - The supplier must have experience in the design and application of static converters and variable frequency motor drives.
    
    3. Applicability of the trade agreement(s) to the procurement 
    This procurement is subject to the following trade agreement:
    Canadian Free Trade Agreement (CFTA)
    
    4. Set-aside under the Procurement Strategy for Aboriginal Business 
    This procurement is not subject to any set-asides for Aboriginal Suppliers.
    
    5. Comprehensive Land Claims Agreement(s) 
    This procurement is not subject to a Comprehensive Land Claims Agreement.
    
    6. Justification for the Pre-Identified Supplier 
    This project requires the services of an experienced professionally certified electrical integration engineer with experience in developing integration packages such as required for the CCG Terry Fox rebuild. There is a very limited supply of this expertise in Canada. The supply is further limited by the requirement that the selected contractor committed to meet this requirement are unable to bid on the supply of components of the electrical system during the life extension of the vessel.
    
    The situation is further complicated by the COVID pandemic and the requirement to complete the specifications by June 2021. This requires that the contractor have recent and extensive experience on the vessel and be able to develop the specifications without visiting the vessel as vessel visitations are not permitted at this time. 
    
    To ensure that knowledge gained on previous projects on the ships systems can be applied in the integration of new equipment being installed during the VLE.
    
    Canal is the only firm that we know can meet that requirement.
    
    7. Government Contracts Regulations Exception(s) 
    The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the contract".
    
    8. Exclusions and/or Limited Tendering Reasons
    (iii) due to an absence of competition for technical reasons.
    
    9.Ownership of Intellectual Property
    Canada intends to retain ownership of any Foreground Intellectual Property arising out of the proposed contract on the basis that the main purpose of the contract is (insert appropriate exception to the Treasury Board ARCHIVED - Policy on Title to Intellectual Property Arising under Crown Procurement Contracts, e.g. to generate knowledge and information for public dissemination).
    
    10. Period of the proposed contract or delivery date 
    The proposed contract period is from date of Contract award to March 31, 2024.
    
    11. Cost estimate of the proposed contract 
    The estimated value of the contract, including option(s), is not expected to exceed $100,000.00 (GST/HST extra).
