    To supply the 2013 models of Volvo Penta inboard motors and
    stern drives with their parts and accessories to the government
    departments, agencies and Crown corporations of the Government
    of Canada for delivery across the country, excluding locations
    within the Settlement areas of the Comprehensive Land Claims
    Agreements (CLCA) on an as-and-when requested basis from date of
    standing offer to 31 August 2013. This requirement does not
    contain servicing, installation, or repair & overhaul.
    
    Various government departments, agencies and Crown corporations
    of the Government of Canada across the country require the 2013
    models of Volvo Penta inboard motors and stern drives among the
    commercial brands of outboard motors. Original Equipment
    Manufacturer (OEM) parts are required by the clients for the
    maintenance and repair of existing Volvo Penta inboard motors
    and stern drives. The proposed supplier is the OEM of Volvo
    Penta inboard motors and stern drives.
    
    Individual call-ups against the Standing Offer shall not exceed
    $80,000.00, Goods and Services Tax (GST) or Harmonized Sales Tax
    (HST) included, when selection is based on the lowest price and
    $40,000.00, GST or HST included, when selection is based on the
    most cost effective option that is not the lowest price.
    
    This procurement is subject to limited tendering procedures
    under the World Trade Organization Agreement on Government
    Procurement Article XV, 1. (b), North American Free Trade
    Agreement Article 1016, 2. (b) and Agreement on Internal Trade
    Article 506, 12. (b). This procurement is not subject to CLCA.
    
    If another supplier is capable to offer the same commercial
    brand of outboard motors, inboard motors or stern drives for
    delivery across the country, excluding locations within the
    Settlement areas of the CLCA, a competitive request for a
    standing offer will be issued for that brand.
    
    Four (4) Advance Contract Award Notices (ACAN) are published
    simultaneously to identify the OEM and their commercial brands
    of outboard motors, inboard motors and stern drives.
    ACAN E60ML-120001/A, Yamaha Motor Canada Ltd., Toronto, Ontario,
    Yamaha brand;
    ACAN E60ML-120001/B, Mercury Marine Limited, Milton, Ontario,
    Mercury and Mercury Mercruiser brands;
    ACAN E60ML-120001/C, BRP US Inc., Sturtevant, Wisconsin, United
    States of America, Evinrude brand; and
    ACAN E60ML-120001/D, Volvo Penta Canada, Inc, Burnaby, British
    Columbia, Volvo Penta brand.
    
    The Notice of Proposed Procurement (NPP) E60ML-120001/E is
    published simultaneously to provide opportunities to Aboriginal
    businesses to supply the 2013 models of Yamaha, Mercury, Mercury
    Mercruiser, Evinrude or Volvo Penta brands of outboard motors,
    inboard motors or stern drives with their parts and accessories
    to the government departments, agencies and Crown corporations
    of the Government of Canada for delivery across the country,
    including locations both within and outside the Settlement areas
    of the CLCA, also available on national master standing offers
    from the OEM excluding locations within the Settlment areas of
    the CLCA on an as-and-when requested basis.
    
    The Letter Of Interest (LOI) E60ML-120001/F is published
    simultaneously to determine interest of any new OEM, that does
    not currently have a national master standing offer, capable to
    supply it's commercial brand of outboard motors, inboard motors
    or stern drives with their parts and accessories to the
    government departments, agencies and Crown corporations of the
    Government of Canada for delivery across the country, excluding
    locations within the Settlement areas of the CLCA on an
    as-and-when requested basis.

    You are hereby notified that the government intends to negotiate
    with one firm only as identified above. Should you have any
    questions concerning this requirement, contact the contracting
    officer identified above.
    
    An Advance Contract Award Notice (ACAN) allows departments and
    agencies to post a notice, for no less than fifteen (15)
    calendar days, indicating to the supplier community that it
    intends to award a good, service or construction contract to a
    pre-identified contractor. If no other supplier submits, on or
    before the closing date, a Statement of Capabilities that meets
    the requirements set out in the ACAN, the contracting authority
    may then proceed with the award.  However, should a Statement of
    Capabilities be found to meet the requirements set out in the
    ACAN, then the contracting authority will proceed to a full
    tendering process.
    
    Suppliers who consider themselves fully qualified and available
    to provide the services/goods described herein, may submit a
    statement of capabilities in writing to the contact person
    identified in this Notice on or before the closing date of this
    Notice. The statement of capabilities must clearly demonstrate
    how the supplier meets the advertised requirements.
    
    The PWGSC file number, the contracting officer's name and the
    closing date of the ACAN must appear on the outside of the
    envelope in block letters or, in the case of a facsimile
    transmission, on the covering page.
    
    The Crown retains the right to negotiate with suppliers on any
    procurement.
    
    Documents may be submitted in either official language of Canada.
