ADVANCE CONTRACT AWARD NOTICE (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. DEFINITION OF THE REQUIREMENT Public Works and Government Services Canada on behalf of the Minister of National Defence (DND) wishes to issue a Standing Offer for the provision of Inspection and Certification Services of a Cessna 305 (L19) parts in accordance with Transport Canada’s approved procedures for the certification of undocumented parts. The work will involve the following: 2.1 Inspection Report 2.1.1 The Service Provider must provide a detailed report for each of the different parts inspected, in accordance with the standards approved by Transport Canada. Several identical parts, which are in the same state, may be included on the same certification document. 2.1.2 The report, in hard copy, shall include the following documents: a. The Work Report form (in English); b. The document for the evaluation of aircraft parts without documentary support (in French); c. The Form One document, signed by the certified inspector (in English); d. A picture of the inspected part; e. A copy of the technical drawing; and f. A copy of the part from the aircrafts part manual. 2.2 Inspection Planning 2.2.1 The Service Provider must ensure that the part inspection is carried out within a maximum of 30 working days following receipt of the parts to be certified. 2.2.2 If several lots of parts are delivered, each lot must be processed within 30 working days in succession. For example, lot #1 is processed in 30 days, lot #2 will be processed within the 30 days following lot #1 and lot #3 will be processed within the 30 days following lot #2. 2.3 Limitation and Constraints (a) A maximum of 15 parts can be sent for inspection in one lot. If more than 15 parts are sent, they will be grouped in batches of 15 parts each, with a purchase order for each batch of parts. DND is responsible for identifying the priority order in which the lots are to be processed by the Supplier. (b) In the event that a part or several parts are required rapidly to return an aircraft to service, the Provider must be able to certify one to three parts within 48 hours of delivery to the workshop. (c) The certification documents must be submitted with the parts in order to avoid confusion. (d) When the parts will be returned to the DND by the carrier, the Provider shall package parts optimally to minimize the risk of damage. (e) The Provider must ensure that the parts assigned by the DND for inspection are always kept in a safe place to prevent theft or damage. (f) Non-compliant parts must be accompanied by a red label. The part number will be entered as well as a brief description of the anomaly that was found. 2.4 Transportation The DND will ensure the transportation and return of parts for certification. In the event that the DND is not available to do so, a courier company appointed and paid for by the DND will handle the delivery and collection of parts at the Service Provider. 3. CRITERIA FOR ASSESSMENT OF THE STATEMENT OF CAPABILITIES (MINIMUM ESSENTIAL REQUIREMENTS) Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements: (A) The Service Provider must be an Approved Maintenance Organization (AMO) recognized by Transport Canada; AND (B) The Service Provider must be authorized by Transport Canada to certify the Cessna 305 parts in accordance with the Canadian Aviation Regulations (CAR) 571 Appendix H; AND (C) The inspector designated by the AMO for the certification of parts shall have an X level 1 fluorescence user certification based on the International Standard ISO 20807, issued by Natural Resources Canada. 4. APPLICABILITY OF THE TRADE AGREEMENT(S) TO THE PROCUREMENT This procurement is subject only to the Canadian Free Trade agreement. 5. JUSTIFICATION FOR THE PRE-IDENTIFIED SUPPLIER The Cessna 305, built in 1950, was transferred to National Defense for the Air Cadet Program in 2015 for the Air Cadet program. After several discussions with Transport Canada regarding the certification of the parts of this aircraft, Transport Canada made the decision that the proposed supplier for this work be, not only an AMO in Quebec, but be accredited for the certification of Cessna 305 parts through a process described in the CARs (Canadian Air Regulations) Standard 571 Appendix H "Non-Documented Aircraft Parts Evaluation Process". To the best of our knowledge, Aviation BL Inc. is the only qualified aircraft maintenance facility in North America to certify Cessna 305 parts in accordance with CAR 571 Appendix H in accordance with the criteria required by Transport Canada. 6. GOVERNMENT CONTRACTS REGULATIONS EXCEPTION The following exception to the Government Contracts Regulations is invoked for this procurement: Section 6(d) - "only one person is capable of performing the work". 7. EXCLUSIONS AND/OR LIMITED TENDERING REASONS The following exclusions and/or limited tendering reasons are invoked under: (a) Article 513.1(b)(iii) of the Canadian Free Trade Agreement (CFTA). 8. PERIOD OF THE PROPOSED CONTRACT OR DELIVERY DATE The term of the proposed Standing Offer is for an initial term of two (2) years from the date of award and includes three (3) options to extend of 12 months each. 9. COST ESTIMATE OF THE PROPOSED STANDING OFFER The estimated value of the Standing Offer, including options, is approximately $500,000.00 CAN including applicable taxes. 10 NAME AND ADDRESS OF THE PRE-IDENTIFIED SUPPLIER Aviation B.L. SUPPLIERS’ RIGHT TO SUBMIT A STATEMENT OF CAPABILITIES Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 12. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
