An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. Public Works and Government Services Canada (PWGSC) intends to negociate a contract with the supplier Avensys for the procurement and delivery of a 5800 refrigerated water sampler systems with a pump heater (120VAC, 60 hZ), control panel, refrigeration unit, distributor arm, two pump tubes, instruction manual and pocket guide. A 24 container ProPak configuration which includes 25 holders, 100 bags, bottle rack , polypropylene wedgeshaped bottles with caps and Pro Pak cups with Teflon liners. Quantity: 1 each This item is to be delivered to Environment Canada located in Burlington, Ontario. This procurement is subject to the following trade agreements: . Agreement on Internal Trade (AIT) . North American Free Trade Agreement (NAFTA) . Canada-Peru Free Trade Agreement . Canada-Colombia Free Trade Agreement Justification of the Pre-selected supplier: Avensys is the only Canadian distributer capable of meeting Environment Canada's requirement due to logistical and compatibility reasons, where the introduction of a non-standard unit and /or manufacturer would cause operating difficulties, compatibility issues , maintenance problems and additional manipulation and handling costs. The following limited tendering reason is being invoked under the Agreement of Internal Trade: Article 506, Section 12 . To ensure compatibility with existing products, to recognize exclusive rights, such as exclusive licences, copyright and patent rights, or to maintain specialized products that must be maintained by the manufacturer or its representative; The following limited tendering reason is being invoked under the North American Free Trade Agreement (NAFTA) - Article 1016, Section 2(b) . Where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists: No substitute justifications Environment Canada intends to use this equipment to conduct monitoring in remote and harsh environments and which is enabled by a flow meter. The refrigerated water sampler systems must be purchased from Avensys for the following reasons: 1. This sampler must operate year round in remote and open environments and must be capable of resisting corrosion and operating at temperatures from -29 to + 49 degrees celcius. 2. This sampler must be able to collect samples that can be refrigerated in the summer and heated in the winter. 3. This system must be able to collect and log a 24 hour summary of temperature to confirm proper sample cooling. 4. This system must produce output data on sample results and sample programming in ASCII format. 5. The Avensys ISCO refrigerated water quality samplers are currently on Environment Canada's inventory and operating to deliver on their mandate. Avensys has demonstrated that they can deliver the required systems in an effective and efficient manner to justify the augmentation of their existing inventory. 6. This proposed system is compatible with the existing equipment at Environment Canada and will be part of their inventory. The systems form a network of samplers and the data collected between all systems needs to be compatible. To change the product would not be cost effective as Environment Canada would have to implement additional protocols and standards operating procedures and training of the staff on multiple systems. For all the above reasons, this is the only known existing system that is capable of performing this requirement. Delivery date: 6 weeks at receipt of order , if at all possible The purpose of this Advance Contract Award Notice (ACAN) is to signal the government's intention to award a contract for these goods to: Avensys 422 Consumers Road, Toronto, Ontario M2J 1P3 Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. If other potential suppliers submit a statement of capabilities during the posting period that meet the requirements set out in the ACAN, the government will proceed to a full tendering process on either the government's electronic tendering service or through traditional means, in order to award the contract. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
