If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. Definition of the requirement The Department of Environment Canada has a requirement for the supply of a transient recorder data acquisition system. The signal receiver portion of the data acquisition system is comprised of fully enclosed Hamamatsu R9880 photomultiplier (PMT) modules capable of both analogue and photon counting signal detection. The data recorder portion of the system is comprised of transient recorders capable of resolving both analogue and photon-counting signals from the PMT. High-voltage modules are included in the system to power the PMTs. The system is operable over Ethernet. The transient recorder technology is to be identical to other transient recorders already deployed in other Environment Canada Lidar data acquisition systems, which Environment Canada has used for several years and for which has developed software and analysis tools. Licel is the international standard manufacturer of such technology used within the Lidar community. The transient recorder data acquisition system must be required to operate both with an on-site operator and from a remote location. It must operate in an enclosed location with minimal maintenance requirements. It must be able to operate for extended periods of time with a 24/7 duty cycle. The transient recorder data acquisition system is being purchased to be incorporated in the receiver of an autonomous aerosol Lidar to be deployed to the Canadian Arctic for monitoring of aerosol transport and dynamics. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements) The bids must be in technical conformance to the items called for in this requirement in order to be considered. Failure to meet with this requirement will render the bid non responsive and the bid will be rejected. Any interested supplier must demonstrate by way of a statement of capabilities that its product meets the following requirements: Mandatory technical specifications These are the following deliverables: A rack - 6 mounted, 6 channel transient recorder system complete with 6 PMT modules, rack-mounted high-voltage modules, cables and Ethernet controller. Manufacturer: Licel GMBH Transient recorder requirements Must operate at 12 bit, 40Ms/s analogue, operate at 250 MHz photon counting, memory depth 32768 bins * 25ns, 245.76 km max range, and to include an Ethernet interface module for the control and readout of up to 6 transient recorders. Model: TR40-12bit x 6 Manufacturer: Licel GMBH PMT Requirements: Must be based on Hamamatsu R9880U super-bialkali or multialkali mini PMT. Must include a -50.....-1000V HV supply and cables. Model: PM-HV-R9880U-110 Manufacturer: Licel GMBH Or Model: PM-HV-R9880U-20 Manufacturer: Licel GMBH HV supplies must be 19'' rack-mounted. Model: PM-Rack 8 Manufacturer: Licel GMBH Applicability of the trade agreement(s) to the procurement This procurement is not subject to the following trade agreements. - Agreement on Internal Trade (AIT) - North American Free Trade Agreement (NAFTA) Comprehensive Land Claims Agreeement This procurement is subject to the Nunavut Land Claims Agreement. Justification for the Pre-Identified Supplier Boston Electronics Corporation is the authorized dealer for Licel GMBH products in North America. This pre-identified supplier is capable of providing and meeting the government's requirements. Government Contracts Regulations Exception The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work". Exclusions and/or Limited Tendering Reasons The following exclusions and/or limited tendering reasons are invoked under the section of the trade agreement specified: - Agreement of Internal Trade (AIT) - Chapter V, Procurement. Article 506 Procedures for procurement, article 12(a). - North American Free Trade Agreement (NAFTA) - Chapter 10, Annexe 1001.1a-1 Products. Section B - List of certain products, the NIBS '59' is not on this list and moreover exceptions at article 1018 (1) apply to this purchase. - Limited tendering reason is invoked under Chapiter 10 , The limited tendering reasons for the North American Free Trade Agreement (NAFTA), under Article 1016: Limited Tendering Procedures 2 (d). Note: In general, the Supply manual refers only to NAFTA and the WTO-AGP, as the procedural requirements of the other international trade agreements will be fulfilled following compliance to the procedural requirements of NAFTA and the WTO-AGP. See 1.26.16 Bilateral International Trade Agreements. Ownership of Intellectual Property No intellectual property will be created during the course of this Contract. The required delivery date of the Contract The delivery date of the proposed contract is March 25, 2016. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
