    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
    
    Definition of requirement:
    
    Public Services and Procurement Canada, on behalf of The Department of Fisheries and Oceans (DFO), Science Branch in the Newfoundland-Labrador Region has a requirement for the delivery of a contract for Collaborative Research Projects. The purpose of this Advance Contract Award Notice (ACAN) is to signal the government's intention to award a contract for these services to the Fisherman Food and Allied Workers Union (FFAW) for the Fisheries Science Collaborative Program (FSCP). This program was instituted to provide scientific knowledge on fisheries issues through DFO-industry partnering. Specific collaborative projects in Newfoundland and Labrador are designed and approved in accordance with the terms and conditions of the FSCP. All projects under this program are developed during consultations with, and are considered to be priority initiatives by Harvesters, FFAW and DFO Science. Approved projects include recruitment aspects of the post season Snow Crab Pot Survey; Newfoundland Region Lobster Monitoring Project; and Cod Tagging. Other projects may be developed and submitted for approval if funding is available.
    
    Before awarding a contract the government would like to provide other suppliers with the opportunity to demonstrate that they are capable of satisfying the requirements set out in this Notice, by submitting a statement of capabilities during the 15 calendar day posting period.  If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting authority may then proceed with the award to the pre-identified supplier.
    
    Criteria for assessment of the Statement of Capabilities: 
    
    Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:
    
    Minimum Essential Requirements:
    
    Mandatory Technical Criteria
    
    To maintain the integrity of the data series, the bidder must have access to a large number of survey/project platforms over a wide geographic range (NAFO Divisions 2J3KLPs and 2J3KLNOP4R).
    
    Point Rated Technical Criteria
    
    Technical Proposal (40 points)
    
    (20 pts) - Understanding of the scope and objectives of the Fisheries Science Collaborative projects including survey design and application of survey results to the assessment process.
    
    (20 pts) - Proposed approach and methodology including organizational ability to mobilize and oversee a large number of survey vessels (commercial vessels) over a wide geographic range (NAFO Divisions 2J3KLNOP4R and 2J3KLPs) and from all fleet sectors.
    
    Managerial (30 Points)
    
    (10 pts) - Project Manager with relevant experience including knowledge and background in the stock assessment process.
    
    (10 pts) - Key personnel with relevant experience and qualifications.
    
    (10 pts) - Team organization planned and able to support surveys and projects on a wide geographic scale and with participation by all fleet sectors where applicable.
    
    Experience (30 points)
    
    (5 pts) - Risk of non-performance of work.
    
    (5 pts) - Competence proven similar and related work.
    
    (5 pts) - Sufficient manpower resources including access to commercial platforms over a wide geographic scale and all fleet sectors.
    
    (5 pts) - Management capability.
    
    (5 pts) - A demonstrated commitment by having participated in the developmental planning and investing financial and personnel resources to collaborative scientific studies in the fishery.
    
    (5 pts) - Financial coverage of contract costs.

    Justification for the Pre-Identified Supplier:
    
    The Fishermen Food & Allied Workers Union (FFAW) is the only known organization capable of successfully completing this work. The FSCP is a unique fisheries research program which has been developed by the Science Branch of the Department of Fisheries and Oceans and administered by the FFAW over the last seventeen years. No other organization is known to possess the fisheries infrastructure, experience or working knowledge to deliver the project in these North West Atlantic Fisheries Organization (NAFO) Divisions of Newfoundland and Labrador.
    
    Government Contracts Regulations Exception:
    
    The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work".

    Canada intends to retain ownership of any Foreground Intellectual Property arising from the performance of the Work under the proposed contract on the basis that the main purpose of the contract, or of the deliverables contracted for, is to generate knowledge and information for public dissemination.

    The proposed contract is from date of award (anticipated for 01 April 2021) to 31 March 2022 with two additional one year option periods (these periods may or may not be exercised):

However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
    
    Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
