    1. Advance Contract Award Notice (ACAN) 
    
    An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 
    
    2. Definition of the requirement 
    
    The Department of National Defence (DND), Garrison Petawawa, 2 Service Battalion, Maintenance Company (2 Svc Bn, Maint Coy) has a requirement for the supply and delivery of various types of Temporary Particle Filters for Vehicle Exhaust, in accordance with the following Regulations:
    
    The Temporary Particle Filters for Vehicle Exhaust must meet TRGS 554 (D) & COSHH (GB) regulations and be approved on VERT-Filter list B272 (CH) and TÜV (D).
    
    The product/equipment must function immediately on vehicle engine start up with no pre-warming and be able to filters carcinogenic diesel particles emitted by the vehicles brought in and out of buildings, maintenance bays and workshops.
    
    The product/equipment required is as follows:

    Any interested supplier must demonstrate, by way of a statement of capabilities that its product/equipment meets the following requirements:

    a. Size/dimension: 80 mm diameter pipe and 150 mm sock
    b. Particle Separation: >99% of 0,12u particles or larger
    c. CO Separation: ~30%
    d. Aldehyde Separation: ~90%
    e. HC Separation: ~35%
    f. Engine Size: max. 14 Liters
    g. Max RPM: 1200 RPM
    h. Max Temperature Standard Internal Filter Element: 200°C
    i. Filter Life: ~ 100 starts
    j. Weight: ~5-7 Kg
    k. Disposal: Regular waste
    
    2. Dual Diesel Portable Exhaust Filter Unit with Standard Internal Filter for Trucks and Buses.
    
    a. Size/dimension: 80 mm diameter pipe and 150 mm sock

    5. Replacement Filter for Diesel Portable Exhaust Filter Unit for Cars and Vans 
    
    a. Internal Filter - 2 per box - must fits the Diesel Portable Exhaust Filter Unit for Cars and Vans
    
    4. Applicability of the trade agreement(s) to the procurement 
    
    This procurement is subject to the following trade agreement:
    
    Canadian Free Trade Agreement (CFTA)
    
    5. Set-aside under the Procurement Strategy for Aboriginal Business
    
    This procurement is not a set-aside for Aboriginal supplier, in accordance with the government Procurement Strategy for Aboriginal Business (PSAB).

    This procurement is not subject to any Comprehensive Land Claims Agreement(s).
    
    7. Justification for the Pre-Identified Supplier 
    
    Sourcetec Industries Inc. is the only known authorized Canadian distributor for EHC Teknik ab capable of providing the required product/equipment that meet the specifications identified in Article 3. - Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements).
    
    It is proposed to negotiate directly with Sourcetec Industries Inc. for this requirement.
    
    8. Government Contracts Regulations Exception(s) 
    
    The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6:
    
    (d) - only one person is capable of performing the work. 
    
    9. Exclusions and/or Limited Tendering Reasons 
    
    The following exclusion(s) and/or limited tendering reasons are invoked under the: 
    
    Canadian Free Trade Agreement (CFTA) 
    Chapter Five - Government Procurement 
    Article 513: Limited Tendering 
    
    1. Subject to paragraphs 2 and 3, and provided that it does not use this provision for the purpose of avoiding competition among suppliers or in a manner that discriminates against suppliers of any other Party or protects its own suppliers, a procuring entity may use limited tendering in the following circumstances:
    
    (b) if the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute goods or services exist for any of the following reasons:
    
    (i) the protection of patents, copyrights, or other exclusive rights
    
    (v) to ensure compatibility with existing goods, or to maintain specialized goods that must be maintained by the manufacturer of those goods or its representative
    
    (c) for additional deliveries by the original supplier of goods or services that were not included in the initial procurement, if a change of supplier for such additional goods or services:
    
    (i) cannot be made for economic or technical reasons such as requirements of interchangeability or interoperability with existing equipment, software, services, or installations procured under the initial procurement
    
    (ii) would cause significant inconvenience or substantial duplication of costs for the procuring entity
    
    10. Ownership of Intellectual Property
    
    EHC Teknik ab has rights to the Intellectual Property. 
     
    Ownership of any Foreground Intellectual Property arising out of the proposed contract will vest in EHC Teknik ab.
    
    11. Period of the proposed contract or delivery date 
    
    The product/equipment must be delivered on or before September 28, 2020.
    
    12. Cost estimate of the proposed contract 
    
    The estimated value of the contract is $ 33,050.00 (GST/HST extra).

    Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. 
    
    The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
    
    15. Closing date for a submission of a statement of capabilities 
    
    The closing date and time for accepting statements of capabilities is September 11, 2020 at 2:00 p.m. (EDT).

    You are hereby notified that the government intends to negotiate with one firm only as identified above. Should you have any questions concerning this requirement, contact the contracting officer identified above.
    
    An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award.  However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
