Trade Agreement: Agreement on Internal Trade (AIT) Tendering Procedures: Generally only one firm has been invited to bid Attachment: None Non-Competitive Procurement Strategy: Exclusive Rights Comprehensive Land Claim Agreement: No Vendor Name and Address: Pfizer Canada Inc Pfizer Canada Inc. 17300 Trans-Canada Highway Kirkland Quebec Canada H9J2M5 Nature of Requirements: Requirement PWGSC proposes to contract with Pfizer Canada Inc. for the purchase of 751,836 doses of Prevnar® 13 (Pneumococcal Conjugate vaccine 13 valent) on behalf of the Health Ministries of the provinces of Alberta, Manitoba, New Brunswick, Newfoundland & Labrador, Northwest Territories, Nova Scotia, Nunavut, Ontario, Prince Edward Island, Saskatchewan and Yukon. This requirement includes a federal portion of 5,980 doses on behalf of Health Canada Alberta and The Department of National Defence. Vaccine is to be supplied as and when requested from date of award to March 31, 2015. In addition it is proposed to include the option for three additional one year periods which, if exercised, would end March 31, 2018. Any resulting contract will include an option to add new users and to increase the quantity up to 20% of the total estimated requirement to accommodate the increased requirements of existing users. Each consignee will be obligated to purchase 90% of their estimated requirement. This requirement falls within the Federal/Provincial/Territorial (F/P/T) Group Purchasing Program for Drugs and Vaccines. Applicability of Trade Agreements The provisions of the World Trade Organization Agreement on Government Procurement (WTO-AGP), the North American Free Trade Agreement (NAFTA), the Canada-Chile Free Trade Agreement (CCFTA) and the Canada-Columbia Free Trade Agreement Canada - Peru Free Trade (FTA) are not applicable for reasons connected with the protection of human life and health (see NAFTA article 1018 para. 2 (a) and (b); WTO-AGP article XXIII (2); CCFTA article Kbis-16 para. 2 (b); and FTA article 1402 para. 2 (b) ), and because of the absence of regulatory harmonization between Canada and the other signatory countries to the WTO, NAFTA, CCFTA and FTA. This requirement is subject to the Agreement on Internal Trade (AIT). Limited Tendering Reason Responsibility for health care delivery (including the purchase of vaccines) lies with Provincial and Territorial governments. Each Designated User in the F/P/T Group Purchasing Program has specific needs and individual program delivery requirements. It is proposed to negotiate this requirement directly with Pfizer Canada Inc. on behalf of the noted Designated Users as the Pfizer product is the only product that can be considered at this time for the following reasons : Jurisdictions are not in a position to consider an alternative to Prevnar ® 13 because it is the only licensed Pneumococcal Conjugate vaccine to cover 13 serotypes and be indicated for infants and children less than 5 years in age; Prevnar ® 13 provides the broadest available protection against the maximum number of serotypes of pneumococcal disease. Delivery Date: Above-mentioned You are hereby notified that the government intends to negotiate with one firm only as identified above. Should you have any questions concerning this requirement, contact the contracting officer identified above. An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process. Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page. The Crown retains the right to negotiate with suppliers on any procurement. Documents may be submitted in either official language of Canada.
